Council Business <br /> <br />Mayor Gamec called the regular City Council meeting back to order at 8:26 p.m. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to adopt <br />Resolution #01-09-345 through #01-09-359 adopting assessments for Improvement Projects #01- <br />02 through #01-16. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Zimmerman, Kurak, Anderson, <br />and Hendriksen. Voting No: None. <br /> <br />Case #4: Adopt Ordinance to Vacate Road Easement; Case of John Dehen <br /> <br />Community Development Director Frolik stated that Mr. John Dehen of 14806 Bowers Drive <br />N.W. is requesting that the City vacate the excess road easement that exists for Bowers Drive. <br />Mr. Dehen has a failing septic system and he is proposing to replace his septic system in the front <br />yard between the house and Bowers Drive N.W. The Bowers Drive right-of-way, in the vicinity <br />of Mr. Dehen's home, exceeds the standard 66-foot width by as much as 40 feet in some <br />instances. Mr. Dehen needs the excess fight-of-way adjacent to his property for a new drainfield. <br />It has been verified that there are no utilities or road pavement outside of the standard 66-foot <br />right-of-way corridor. On September 11, the City Council intrOduced an ordinance to vacate the <br />excess right-of-way on Bowers Drive. In accordance with the City Charter, the ordinance was <br />eligible for adoption. City staff recommended that the Council adopt the ordinance to vacate the <br />excess roadway easement. <br /> <br />Motion by Councilmember Zimmerman, seconded by Councilmember Kurak, to adopt <br />Ordinance #01-21 to vacate certain excess roadway easements on Bowers Drive NW. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Zimmerman aye <br />Councilmember Kurak aye <br />Councihnember Anderson aye <br />Councilmember Hendriksen aye <br />Mayor Gamec aye <br /> <br />Motion carded. <br /> <br />Case #5: <br /> <br />Request for Final Plat Approval of McDonald 2nd Addition; Case of Robert <br />McDonald <br /> <br />Community Development Director Frolik stated that Robert McDonald is requesting final plat <br />approval to create two new lots from an existing 38-acre homestead and a 5-acre homestead <br /> <br />City Council/September 25, 2001 <br /> Page 15 of 31 <br /> <br /> <br />
