the City Engineer. City Attorney Goodrich explained that, in general, Mr. McDonald could do <br />whatever he wanted to with the property as long as it does not inhibit the City easement. He <br />would not be permitted to construct a berm around the property so that water could not drain <br />onto it. Mr. Goodrich did not think that he would be accepting anymore water on his property <br />than he currently does, but as development comes along more water could be diverted to the area. <br /> <br />Motion carded. Voting No: None. <br /> <br />Mr. McDonald stated that when they developed the land ten years ago they felt they were held <br />hostage, because in order to have the land developed they had to give seven acres for park <br />development and now they have to hand over more land and then the City will be generous <br />enough to let them hay it. They have gone out of their way to work with staff and they want to <br />sell the property and move out of the City of Ramsey, which cannot be soon enough with the <br />problems they are having. <br /> <br />Mayor Gamec replied that they have to look after the interest of the whole City, but they will try <br />and move the issue along as fast as they can. <br /> <br />Case/46: <br /> <br />Request for a Conditional Use Permit to Exceed Accessory Structure Square <br />Footage Restrictions; Case of Bradley Wolf <br /> <br />Community Development Director Frolik stated that the City received an application from <br />Bradley Wolf requesting a conditional use permit to exceed the accessory structure square <br />footage restrictions established in City Code on the property located at 6421 Green Valley Road <br />NW. The proposed use of the building is for agricultural purposes. State Building Code <br />exempts structures meeting the definition of agricultural building from building permit <br />requirements. However, this does not exempt agricultural buildings from local zoning <br />regulations such as setbacks, height, size, etc. The subject property is approximately 53 acres in <br />size and is zoned R-1 Rural Residential. City Code allows a maximum of 5,664 square feet of <br />accessory structure space on parcels 10.6 acres and greater in size. The applicant currently <br />maintains 6,454 square feet of accessory structure space on the subject Property, which exceeds <br />City Code restrictions by 790 square feet. Mr. Wolf needs to replace an existing 38' x 65' (2,470 <br />square feet) accessory structure because the structure is deteriorating. Mr. Wolf would like to <br />replace the existing accessory structure with a 40'x 96' (3,840 square feet) accessory structure. <br />The larger accessory structure is needed to facilitate projected storage needs for Mr. Wolf's <br />personal equipment and for the storage of farm related materials and equipment by persons who <br />rent farm land from Mr. Wolf. The accessory structure would also serve as long term storage of <br />agricultural items that are used for Green Valley Green House's business (located across the <br />street from the subject property). Mr. Wolf is employed by Green Valley Green House and is <br />proposing to provide longer term storage of agricultural items that Green Valley Green House <br />will buy in bulk. These items include potting soil, pots, planting trays etc. Green Valley <br />Greenhouse employees would access the accessory structure on Mr. Wolf's property on an <br />average of a couple times a month.
