structure on the subject property will result in a total of 7,824 square feet of accessory structure <br />space on the property. This would exceed City Code accessory structure restrictions by 2,160 <br />square feet. The City has granted conditional use permits in the past for accessory structure <br />square footage overages. From 1997 to 2001, the City has granted approximately I3 conditional <br />use permits for accessory structure square footage overages. The Planning Commission met on <br />September 10, 2001, to review the conditional use permit request and held a public hearing. <br />There was no citizen input during the public hearing. The Planning Commission recommended <br />that the City Council deny the conditional use permit request. Their recommendation for denial <br />is based on the opinion that if this structure is supposed to provide warehouse space for Green <br />Valley Greenhouse, then the structure should be built on the same complex as the Green Valley <br />Greenhouse (south side of Green Valley Road). <br /> <br />Councilmember Zimmerman stated that the City has been somewhat lenient on granting <br />overages in the past, however this particular request has two different facets. One is the overage <br />of buildings, and the second is that the use is for a business. <br /> <br />Community Development Director Frolik replied that that was tree, but the type of building <br />qualifies as an agricultural use. <br /> <br />Councilmember Kurak read MN State Building Code pertaining to agriculture land. She did not <br />see where there would be any problem with leasing out the extra space for agricultural use. In <br />regards to the overages, the City has granted many overages. She was comfortable with allowing <br />the overages for use by Green Valley Greenhouse because it is an agricultural business. <br /> <br />Councilmember Hendriksen inquired as to what the agricultural items are that will be stored in <br />the building. <br /> <br />Mr. Wolf replied soil, pots, etc. <br /> <br />Councilmember Hendriksen stated that the State Building Code pertaining to agricultural land <br />pertains to leasing their own property not a use by another entity. He inquired as to what would <br />happen if Cub Foods wanted to store things in the building. <br /> <br />Councilmember Kurak replied that that would not be included as an agriculture use. <br /> <br />City Attorney Goodrich noted that if Cub Foods was in the business of trees, shrubs, etc. they <br />could use the building. <br /> <br />Councilmember Anderson inquired if they are simply moving impervious surface across the <br />street. <br /> <br />Community Development Director Frolik noted that Mr. Wolf's storm drainage utility fee would <br />be adjusted because of the additional impervious surface. <br /> <br />City Council/September 25, 2001 <br /> Page 20 of 31 <br /> <br /> <br />
