Mr. Wolf replied that he was aware of that. <br /> <br />Councilmember Kurak noted that Mr. Davis of Green Valley Greenhouse has nothing to do with <br />the application other than he will be leasing from Mr. Wolf. <br /> <br />Councilmember Anderson inquired as to why Mr. Davis does not build on his own site. <br /> <br />Councilmember Kurak replied that that is not the issue. <br /> <br />Wayne Davis, 6530 Green Valley Road NW, Ramsey, stated that the barn that is existing is <br />starting to have structure problems and they would like to build a slightly bigger building to store <br />materials. He explained that he bought the land years ago to use the existing buildings for <br />storage and later sold the land to Mr. Wolf. <br /> <br />City Attorney Goodrich stated that the leasing of the building should not be an issue, because the <br />products they intend to store, as along as they are for agricultural purposes, is permitted. <br /> <br />Richard Krueger, Ramsey, stated that with agricultural land, the only thing they have to do is <br />meet setbacks and the Planning Commission overlooked that fact. <br /> <br />Community Development Director Frolik noted that the State Building Code exempts <br />agricultural buildings from building permits, but does not exempt them from the local zoning <br />regulations. <br /> <br />Mayor Gamec stated that because of the location of the property, he does not have a major <br />problem with the request, but he does not want to see any further redevelopment. <br /> <br />Councilmember Hendriksen stated that he is not concerned with the size of the building, but the <br />reason the City has size regulations on buildings is because they become commercial uses, as <br />long as the City Attorney is sure that the building will be used for agricultural uses and they are <br />not setting precedent in other areas his concern is elevated. <br /> <br />City Attorney Goodrich stated that he is sure that the fact that the agricultural products are not <br />being produced on the site and being stored on the property is permitted. If Mr. Wolf starts <br />storing snowmobiles for Arctic Cat then there is a problem. <br /> <br />Mayor Gamec inquired if they could stipulate that the conditional use permit is strictly for <br />agricultural use. <br /> <br />Mr. Wolf replied that the building would be used for personal use and agricultural products. <br /> <br />The Council reviewed the findings of fact and made the following changes: <br /> <br />· Findings 11, 12, 14, and 16 was changed to "will not" <br /> <br />City Council/September 25, 2001 <br /> Page 21 of 31 <br /> <br /> <br />
