Finding 15 was changed to "will" <br />Finding 18 was added as follows "State law preempts local zoning and permits agricultural <br />uses on the subject property." <br /> <br />Motion by Councilmember Hendriksen, seconded by Councilmember Kurak, to adopt Resolution <br />#01-09-360 adopting Findings of Fact # 0574 favorable to the applicant as amended, relating to <br />Mr. Wolf's request for a conditional use permit to exceed accessory structure square footage <br />restrictions established in City Code. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Hendriksen, Kurak, Anderson, <br />and Zimmerman. Voting No: None. <br /> <br />Councilmember Hendriksen stated that the conditional use permit should restrict the use of the <br />building to agricultural uses. <br /> <br />The conditional use permit was amended as follows: <br /> <br />Condition #5 was removed. <br />Condition #7 was amended to read as follows: "That the accessory structure shall be used for <br />agricultural purposes as defined by Minnesota State Statue Section 273.13 and personal <br />residential uses only." <br />Condition #11 was amended to read as follows: "This Conditional Use Permit shall <br />automatically expire if the building is not constructed by September 25, 2002. The Permittee <br />may petition for an extension of time in which to initiate the permit. Such extension shall be <br />requested in writing and filed with the City at least 30 days before the expiration of the <br />original permit." <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#01-09-361 to approve Mr. Wolf's request for a conditional use permit, as amended, to exceed <br />the accessory structure square footage restrictions established in City Code based on the Findings <br />of Fact #0574. <br /> <br />Motion carded. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />and Zimmerman.
