Young reside at 6421 - 154th Lane NW and they are requesting a conditional use permit to <br />maintain a second dwelling on their property to provide living quarters when they retire and <br />immediate living quarters for Mrs. Young's mother. The Subject Property is approximately 1.3 <br />acres in size and is located in the Rural Residential Area. Mr. and Mrs. Young have an existing <br />576 square foot (24' x 24') detached garage that serves as their primary garage. The Youngs <br />would like to construct another two story 960 square foot (24' x 38') detached garage. The <br />proposed accessory structure would serve two purposes for the Youngs; they would like to store <br />personal recreational items on the first floor and utilize the second floor as a future retirement <br />living quarters for themselves and immediate living quarters for Mrs. Young's mother. Mr. and <br />Mrs. Young do not intend to rent or lease the dwelling to persons at large. City Code allows a <br />total of 1,664 square feet of accessory structures on the subject property. The proposed accessory <br />structure and existing detached garage would equal 1,536 square feet, which meets City Code <br />requirements. The conditional use permit request is in regard to the desire to add a second floor <br />to the accessory structure for a secondary dwelling on the property. If the Applicants would like <br />to construct the accessory structure and use it for personal storage, they would only be subject to <br />the building permit process. The subject property is serviced by an on-site septic and well <br />system. The applicants would be required to install a second septic system to service the <br />proposed second dwelling and therefore a determination as to whether or not another septic <br />system can be located on the property will need to be made by a site inspector. The Minnesota <br />Pollution Control Agency requires that for each septic system located on a property, an alternate <br />location must be determined in case of a septic system failure. In this case, two alternate septic <br />system locations or one alternate site that provides sufficient capacity for two dwelling units will <br />need to be determined on the subject property. When the City Council reviewed previous <br />requests for conditional use permits to maintain two dwellings on a parcel, it was stated that <br />requests for two dwellings on a property should be viewed as a means to remedy a unique or <br />already existing situation. The Council made a statement that they do not wish to set a precedent <br />in allowing two dwellings on a parcel when new construction is required. The Planning <br />Commission met on September 10, 2001, to review the conditional use permit request and hold a <br />public hearing. There was no citizen input during the public hearing. The Planning Commission <br />recommended denial of the conditional use permit request based on the direction the City <br />Council has given in the past regarding new construction of second dwellings on a parcel. <br /> <br />Mayor Gamec stated that typically second dwellings have not been permitted in the City. He <br />explained that there were a couple of situations where second dwellings were permitted where a <br />structure already currently existed on the property. <br /> <br />Mayor Gamec stated that he could not support the request at this time because it does set <br />precedent. <br /> <br />Mr. Young, 6421 - 154th Lane NW, Ramsey, stated that the building would be living quarters. <br />He explained that his mother-in-law is 75 and they would like to give her a peaceful home for the <br />rest of her life. After that, their son wants to buy the homestead and they would like to live on <br />the homestead as well in the second dwelling. He felt that he has enough land to accommodate <br />the two dwellings and all of their neighbors have okayed it as well. <br /> <br />City Council/September 25, 2001 <br /> Page 23 of 31 <br /> <br /> <br />
