Councilmember Hendriksen stated that earlier in the Finance Committee they were wrestling <br />with a situation where the City did not develop an outlet for the drainage pond in Business Park <br />95. He questioned if they should be resolving the drainage issue first before granting preliminary <br />plat approval. <br /> <br />Councilmember Zimmerman stated that he would hope that the pipe would be in the ground <br />before the homes are constructed. <br /> <br />City Engineer Olson replied that he would agree with Councilmember Zimmerman 100 percent. <br />He noted that staff did include that the outlets need to be identified as part of final plat approval <br />in the City staff review letter. <br /> <br />Mayor Gamec inquired if there was a consensus amongst the Council to cul-de-sac Yakima <br />Street to the north. <br /> <br />Councilmember Anderson replied that she felt that Yakima Street should remain a through street <br />because the residents along 156th Lane may not be able to turn left onto T.H. #47 in the future <br />and would need access to 153rd Avenue. <br /> <br />Councilmember Kurak stated that she would not have an objection to making the connection at <br />155'h Lane as only an emergency vehicle entrance. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />#01-09-329 granting preliminary plat approval of Centex Homes Option B, contingent upon the <br />drainage issue being addressed. <br /> <br />Further discussion: Councilmember Hendriksen inquired if they should be addressing the <br />$130,000 amount in unidentified funds for the outlet. Councilmember Kurak replied that staff <br />should address the issue in the most appropriate manner identifying how the developer will pay <br />for the $130,000 deficit. Councilmember Hendriksen inquired if Councilmember Kurak was <br />suggesting that the City not pay that additional cost. Councilmember Kurak replied that was <br />correct. Councilmember Zimmerman stated that he was disappointed that the City did not give <br />the existing residents some density transitioning. Councilmember Hendriksen stated that an offer <br />was made by the developer to put some covenants in place to provide buffering and questioned if <br />that is included in the preliminary plat voted on. Dan Blake, Centex Homes, replied that the <br />additional primary structure restriction area is part of the preliminary plat presented and would be <br />included in any action taken. Councilmember Hendriksen inquired as to how that area will be <br />implemented. Community Development Director Frolik replied that it will be addressed in the <br />development agreement. Mr. Blake replied that they would probably create some type of <br />easement in favor of the City that would restrict what could and could not be constructed in that <br />area. <br /> <br />City Attorney Goodrich recommended the following motion: To grant preliminary plat approval <br />requiring street alignment Option B, subject to compliance with City Code requirements and City <br /> <br />City Council/September 11, 2001 <br /> Page 11 of 23 <br /> <br /> <br />
