platting policy, subject to compliance with the July 5th and August 21, 2001 City staff <br />compliance letters, including the developer requirement to pay for all drainage requirements <br />generated by the plat, subject to the development agreement including buffering as presented by <br />the Developer at this evening's meeting to be included in the final document agreement and in a <br />legal document approved by the City Attorney, and direct staff to investigate an emergency <br />access on 155th Lane with the final decision to be made at the time of final plat approval. <br /> <br />Motion was amended as recommended by the City Attorney. <br /> <br />Motion and amendment carded. Voting Yes: Mayor Gamec, Councilmembers Kurak, and <br />Anderson. Voting No: Councilmember Hendriksen and Zimmerman. <br /> <br />Case #4: <br /> <br />Request for a Conditional Use Permit to Exceed Accessory Structure Space <br />Restrictions; Case of Charles Lind <br /> <br />Community Development Director Frolik stated that the City Council met on August 28, 2001 to <br />review Mr. Lind's conditional use permit request. At the City Council meeting, the City Council <br />adopted findings of fact favorable to the applicant and directed staff to draft a conditional use <br />permit approving Mr. Lind's request to exceed accessory structure square footage requirements. <br /> <br />Motion by Mayor Gamec, seconded by Councilmember Kurak, to approve Mr. Lind's request for <br />a conditional use permit to exceed the amount of accessory structure space allowed on the <br />property based on the findings of fact and adopt Resolution #01-09-330 declaring terms of same. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, Hendriksen, <br />and Zimmerman. Voting No: None. <br /> <br />Mayor Gamec recessed the regular meeting of the City Council at 9:11 p.m. <br /> <br />Mayor Gamec call the regular meeting of the City Council back to order at 9:17 p.m. <br /> <br />Case #6: Introduce Ordinance to Vacate Road Easement; Case of John Dehen <br /> <br />Mayor Gamec closed the regular portion of the City Council meeting at 9:18 p.m. in order to <br />conduct a public hearing. <br /> <br />Public Hearing <br /> <br />Mayor Gamec called the public hearing to order at 9:18 p.m. <br /> <br />Presentation <br /> <br />Community Development Director Frolik stated that Mr. John Dehen of 14806 Bowers Drive <br />NW, Ramsey is requesting that the City vacate a portion of the roadway easement that exists for <br /> <br />City Council/September 11, 2001 <br /> Page 12 of 23 <br /> <br /> <br />
