133 <br />6115.1320 DEFINITIONS. <br />MINNESOTA RULES 6115.1340 <br />Subpart 1. Scope. For the purposes of these parts certain terms or words used herein shall be <br />interpreted as follows. <br />Subp. 2. Boundary rivers. "Boundary rivers" means the Red River of the North and the Bois <br />de Sioux River as they form a natural boundary between the states of Minnesota and North Dakota. <br />Subp. 3. Dike. "Dike" means an embankment constructed of earth and/or other suitable materials <br />to protect agricultural lands. <br />Subp. 4. Farmstead. "Farmstead" means a farm dwelling and/or associated farm buildings. <br />Subp. 5. Flood frequency. "Flood frequency" means the average frequency, statistically <br />determined, for which it is expected that a specific flood stage or discharge may be equalled or <br />exceeded. This frequency is usually expressed as having a probability of occurring, on the average, <br />once within a specified number of years. <br />Subp. 6. Flood waters. "Flood waters" means those waters which temporarily inundate normally <br />dry areas adjoining a watercourse. This inundation results from an overflow of the watercourse <br />caused by excessive amounts of rainfall and/or snowmelt which exceed its capacity. <br />Subp. 7. Public waters. "Public waters" means all natural and altered natural watercourses <br />with a total drainage area greater than two square miles, except that trout streams officially designated <br />by the commissioner shall be public regardless of the size of their drainage area. <br />Subp. 8. Watercourse. "Watercourse" means a channel in which a flow of water occurs either <br />continuously or intermittently in a definite direction. Dike setbacks and elevation. Dikes are to be constructed at a location and elevation <br />so as not to cause an increase in elevation of the 100-year frequency flood of more than one-half <br />foot at any point along the river. Calculation of the effects of the dikes shall be based on an assumed <br />equal degree of encroachment along the opposite side of the river.
