Voting No: None. <br /> <br />Case #4: <br /> <br />Request for a Conditional Use Permit to Display an Advertising Sign in a <br />Residential District; Case of Timothy Bergersen <br /> <br />Community Development Director Frolik stated that Timothy Bergersen has applied for a <br />conditional use permit to display an advertising sign in a residential district on the property <br />located at 6211 - 167th Avenue NW. Mr. Bergersen is self-employed and has a landscaping <br />business. He parks his commercial vehicles and equipment at his residence (6211 - 167th Avenue <br />N.W.). He does comply with the requirement to have his commercial vehicles and equipment <br />stored indoors or in an area that screens the equipment to a degree of 75% from the public road <br />and adjacent properties. However, Mr. Bergersen also desires to advertise his business and <br />erected a 32 square foot sign at the entrance to his property. Mr. Bergersen's property is <br />approximately 14 acres in size and is zoned R-1 Rural Residential. City Code does not contain <br />provisions for advertising signs in residential districts. The sign was brought to the attention of <br />City Staff and Mr. Bergersen was advised to remove the sign or attempt to obtain a conditional <br />use permit for the continued use of the sign. Mr. Bergersen's property is located on a Municipal <br />State Aid road. There is a church west of his property and there is a commercial district a short <br />distance to the east. The sign is professionally done with substantial landscaping improvements <br />around it. In the recent past, the Council approved a conditional use permit for a home business <br />on Highway #10 that included a business sign, given the fact that the use was on a State <br />Highway, across the street from commercial uses. (The Home Occupation section of City Code <br />does not permit signage of home businesses.) Some years ago, the Council also granted a permit <br />for a sign on T.H. #47 for an agriculture business in a Residential district. The Planning <br />Commission conducted the public hearing on August 7. There was a resident present expressing <br />support of Mr. Bergersen's request. Subsequent to the Planning Commission meeting, staff also <br />received a letter of support. Recognizing that there are numerous self-employed persons residing <br />in the community that would like to advertise their business from their residential property, the <br /> <br />City Council/August 28, 2001 <br /> Page 16 of 36 <br /> <br /> <br />
