City Attorney Goodrich stated that the conditions run with the property as long as the conditions <br />are complied with, but if the applicant agrees that if the building is sold the new owner would <br />have to reapply then it can be included. <br /> <br />Community Development Director Frolik replied that the conditional use permit would be <br />personal to Mr. Glass and any new owner would have to reapply. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Anderson, to adopt Resolution <br />//01-08-312 adopting Findings of Fact #0568 relating to M & G Leasing's request for a <br />conditional use permit to exceed sign size restrictions. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Anderson, and <br />Zimmerman. Voting No: Councilmember Hendriksen. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to approve M & G <br />Leasing's request to exceed sign size restrictions based on the findings of fact, and adopt <br />Resolution # 01-08-313 declaring terms of the conditional use permit, adding the stipulation that <br />if the building is sold, the conditional use permit would terminate and the new owner would have <br />to apply for any future signage. <br /> <br />Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Zimmerman, and <br />Anderson. Voting No: Councilmember Hendriksen. <br /> <br />Case #6: <br /> <br />Request for a Conditional Use Permit to Construct and Operate a Cellular <br />Antenna on a City Water Tower; Case of Verizon Wireless <br /> <br />Community Development Director Frolik stated that the City has received an application from <br />Verizon Wireless requesting a conditional use permit to construct and operate cellular antennas <br />on the new City water tower generally located off of Sunwood Drive. The subject property is <br />zoned BW Business Warehouse, surrounding parcels to the north, south, east and west are also <br />zoned BW Business Warehouse. Verizon Wireless is proposing to install cellular antennas on <br />the new City water tower at a height of approximately 110 feet above grade (see site plan). City <br />Code requires all cellular antennas on City owned property to obtain a conditional use permit <br />from the City. The applicant is also proposing to construct a 12-foot by 30-foot (360 square feet) <br />equipment building on the property outside of the water tower base. The City recently approved <br />a conditional use permit request from Verizon Wireless to construct cellular antennas on the City <br />water tower located off of County Road #5. The new City water tower was designed and <br />constructed in a manner to allow for various City equipment and cellular user's equipment to be <br />stored indoors. The City has a construction plan and estimated costs for a second floor <br />mezzanine area. The mezzanine area would be 1,900 square feet in size with the capability to <br />hold 250 pounds per square foot or 262.5 tons. Locating cellular equipment on the mezzanine <br />area will provide the City the opportunity to utilize the property surrounding the base of the <br />water tower for site landscaping, construction of a trail that will connect to an adjacent park, and <br /> <br />City Council/August 28, 2001 <br /> Page 19 of 36 <br /> <br /> <br />
