property, removed a grandfathered billboard that was 200 square feet in size from the parcel.
The City has, in the past, granted conditional use permits to allow for larger signs than allowed
under City Ordinances (Ampride, Burger King, Rivers Bend Plaza, and Ramsey Town Square).
The Planning Commission met on August 7 and there were no verbal or written comments
submitted at the public heating regarding the request to exceed sign size restrictions. The 100
square feet of freestanding sign space per parcel may not be adequate for strip malls or multi-
tenant buildings. The Planning Commission recommended approval of the request to exceed the
sign size restriction.

Councilmember Kurak inquired if it would be possible to include a stipulation in the conditional
use permit that if the property were sold, the new owners would have to reapply for the
conditional use permit since property uses change.

Mickey Glass, M & G Leasing, stated that the building is set up for five tenants, which is why
the larger sign is needed. If the property is sold and they have the same number of tenants then
the sign would still be needed.

Mayor Gamec stated that there might be some future changes along Highway #10 that might
impact the sign and he wants to make sure there is nothing that will impact those changes from
occurring.

Councilmember Hendriksen inquired as to what the zoning ordinance states relative to multiple
tenants.

Community Development Director Frolik replied that the zoning ordinance does not address
multi-tenant buildings, it simply states a 100 square foot sign is permitted for one building.

Councilmember Hendtiksen stated that there are several multiple tenant buildings along
Highway #10 and inquired as to the size of their signs.

Community Development Director Frolik replied that each property was allowed 100 square feet
per parcel.

Councilmember Hendriksen inquired as to what size the Burger King sign was.

Community Development Director Frolik replied that Burger King was permitted an overage of
30 to 35 feet. She also noted that other overages have been granted in the City varying in size.

Councilmember Zimmerman stated that he is comfortable with what the applicant is proposing
and suggested that the Council revisit the issue if the building use changes.

Councilmember Hendriksen inquired if the City would be permitted to do that.

City Council/August 28, 2001
