Community Development Director Frolik replied no. <br /> <br />Councilmember Hendriksen inquired if the applicant had any objection with including that <br />information in the conditional use permit. <br /> <br />Mr. Lind replied no. <br /> <br />Councilmember Kurak stated that the property owner has been working very hard on improving <br />the property. The outside of the house has been cleaned and extensive landscaping has been <br />done. In the petition signed by the residents they asked for three things. One was that the <br />structure be constructed in a timely matter, and two that the structure be used for private <br />residential. She stated that she has been assured that the structure will only be used for private <br />use and she felt that there has been good faith to improve the property. <br /> <br />Mayor Gamec requested that the conditional use permit include that all equipment must be stored <br />inside, the type of building, and that the structure be completed in a timely matter and that it will <br />not be used for commercial business. <br /> <br />Community Development Director Frolik noted that City Code does require buildings have to be <br />finished within one year. ' ' <br /> <br />Councilmember Hendriksen stated that he is inclined to grant the request, but expressed concern <br />that there has been some negative history on the property. He inquired if there was a way for the <br />City to collect a performance bond or deposit that would assure the City won't have ongoing <br />costs associated with enforcing the conditional use permit. <br /> <br />Community Development Director Frolik noted that there is standard terminology in a <br />conditional use permit that states that the permit holder is responsible for all costs in <br />administering the permit. <br /> <br />City Attorney Goodrich inquired if that City has in the past required an escrow on a conditional <br />use permit. <br /> <br />Community Development Director Frolik replied that it has not been done on a residential <br />request. <br /> <br />City Attorney Goodrich noted that City Code does not require an escrow, so the Council could <br />modify that in the future, but could not be used in this instance. <br /> <br />Councilmember Hendriksen inquired if the City Attorney felt that the City was sufficiently <br />protected with the terms of the permit. <br /> <br />City Attorney Goodrich replied if the conditions of the conditional use permit are complied with <br />yes, but it can be difficult to enforce. <br /> <br />City Council/August 28, 2001 <br /> Page 24 of 36 <br /> <br /> <br />
