Community Development Director Frolik noted that since the Planning Commission
recommended denial of the request, the Council would need to review the findings and fact and
determine if any changes should be made. The resolution would also need to be changed.

Consensus of the Council was to amend the findings of fact as follows:

7. That the accessory building will be for storage of three commercial vehicles and several other
personal vehicles and equipment in order to alleviate off-street parking violations.
8. That the commercial business will not be conducted in the building.
13. That the proposed use will not substantially adversely impair the use, enjoyment, or market
value of any surrounding property.
14. That the proposed use will not be disturbing to existing or future neighboring cities.

Motion by Councilmember Kurak, seconded by Councilmember Hendriksen, to adopt Resolution
#01-08-314 adopting Findings of Fact #0569 relating to Mr. Lind's request for a conditional use
permit to exceed the amount of accessory structure space allowed on the subject property as
amended.

Motion carried. In 1985, Mr.
Menard constructed a 5,000 (50' x 100') square foot pole building on the parcel to the west
without also constructing a principal dwelling. City Code states that no accessory structure shall
be built without the presence of a principal structure (dwelling) on the property. This would
result in the existing accessory structure being considered non-conforming. Mr. Menard has
been operating his structural steel and commercial fencing business for the past fifteen (15) years

City Council/August 28, 2001
