City Attorney Goodrich noted that one of the findings of fact states that, in 1985, a building <br />permit was issued. <br /> <br />Community Development Director Frolik noted that Mr. Menard constructed two buildings, with <br />one building being placed on the homestead which was what the building permit was issued for. <br /> <br />City Attorney Goodrich inquired if no building permit was issued for the building on the adjacent <br />lot. <br /> <br />Community Development Director Frolik replied that that was correct. <br /> <br />City Attorney Goodrich noted that #4 of the findings of fact should read that no building permit <br />was issued and that it was constructed without a conditional use permit. <br /> <br />Councilmember Zimmerman stated that on May 23, 2001, the Council denied an application for <br />a woodworking operation so he did not see how they could approve this request. He <br />recommended that the property owner build a house on the property. He felt that a steel <br />warehouse business was out of line. <br /> <br />Lonny Menard stated that one reason the conditional use permit was denied to the woodworking <br />operation is because they wanted a guarantee that they could expand. He explained that he went <br />to the City when he built the building and the building official reviewed the drawing and his <br />recommendation was to buy the adjacent property and build the building on that site. He built <br />the building with the City's recommendation. <br /> <br />Councilmember Kurak stated that she is reluctant to authorize the request. <br /> <br />Mayor Gamec stated that placing a commercial business in the middle of a residential <br />neighborhood is a problem. <br /> <br />Mr. Menard inquired if the area is residential, then why has he been paying commercial taxes for <br />the last 20 years. <br /> <br />Mayor Gamec replied because he has a commercial operation. <br /> <br />Scott Jarmoluk, stated that they would not be processing any steel and that there would be not <br />dumpsters on the site. All material will be brought in, pre-cut. They are simply looking for an <br />area to store the steel until the customers are ready for the material. Everything would be brought <br />in by a truck and forklifted off. <br /> <br />Councilmember Hendriksen inquired if there would be any processing on the site. <br /> <br />Mr. Jarmoluk replied no, noting that the site will only be used for storage. <br /> <br />City Council/August 28, 2001 <br /> Page 27 of 36 <br /> <br /> <br />
