Councilmember Kurak stated that she did not have any objection with the business, but she did
not think that the City could start permitting commercial businesses in a residential area.

Councilmember Zimmerman agreed.

Mr. Jarmoluk noted that in front of the parcel there are power lines and it would be very difficult
to build a house on the site. The building was built as a commercial building with concrete
floors and steel trusses.

Patti Jarmoluk stated that there would not be a lot of truck traffic on the site. She stated that the
site would not be appealing for a house and if it is not used for commercial use she did not what
else it could be used for. She stated that the operation would be very quiet, and no weekends.

Mayor Gamec stated that if a home was on the property operating the business, the use would
probably be permitted, but under these circumstances he did not think they could grant the
permit.

Consensus of the Council was to amend the findings of fact as follows.:

· 4. Deleted from the findings of fact.
· 11. That the proposed use is likely detrimental to persons residing or working in the vicinity
of the use, or to the public welfare.
· 12. That the proposed use may adversely impair the use, enjoyment or market value of any
surrounding property.
· 13. That the proposed use will change the essential character of the area.
· 14. That the proposed use will be disturbing to existing or future neighboring uses.
· 15. That the proposed use will not be a substantial improvement to the property.
· 17. That the proposed use will create excessive additional requirements at public cost for
public facilities and services of the community, such as fire protection.
· 18. Deleted from the findings of fact.

Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to adopt
Resolution #01-08-315 adopting Findings of Fact #0570 relating to the request for a conditional
use permit to operate a steel warehousing business in a residential district as amended.

Motion carried. Voting Yes: Mayor Gamec, Councilmembers Kurak, Zimmerman, Anderson,
and Hendriksen. Voting No: None.

Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to adopt
Resolution #01-08-316 denying the request for a conditional use permit fi.om North Suburban
Steel Supply, Inc. based on the findings of fact #0570.

City Council/August 28, 2001
