Voting No: None. <br /> <br />Case #9: <br /> <br />Consider Adoption of an Ordinance Amending the City's Youth Access <br />Tobacco Ordinance <br /> <br />City Attorney Goodrich stated that this ordinance was introduced at the Council meeting on July <br />24, 2001. Subsequent to that meeting, staff has notified the City's tobacco licensees of the <br />proposed amendments to the youth access to tobacco ordinance and invited them to attend tonight's <br />meeting and to participate in the discussion regarding the proposed amendments. In general, the <br />proposed amendments provide for the codification of the ordinance into the City code, defines the <br />term "exclusive tobacco store", prohibits persons under 18 from entering exclusive tobacco stores, <br />mandates licensees to attend annual city sponsored seminars designed to educate the licensees as to <br />state and local laws relating to tobacco sales and requires the licensees to educate their employees <br />on this subject also. <br /> <br />Motion by Councilmember Anderson, seconded by Councilmember Kurak, to adopt Ordinance <br />#01-18 which is an ordinance directing that Ordinance #98-02 be codified into Chapter 7 of the <br />City Code and amending the following sections of Ordinance #98-02: Section 2. Definitions; <br />Section 3. License; Section 6. Prohibited Sales; Section 8. Self Service Sales and Section 11. <br />Other Illegal Acts. <br /> <br />A roll call vote was performed by the Recording Secretary: <br /> <br />Councilmember Hendriksen aye <br />Councilmember Anderson aye <br />Councilmember Kurak aye <br />Councilmember Zimmerman aye <br />Mayor Gamec aye <br /> <br />Motion carried. <br /> <br />Case #1: <br /> <br />Rescind Application for On-Sale and Sunday Intoxicating Liquor License for <br />Spectators; Case of KBFC, Inc. <br /> <br />Police Chief Gustafson requested that the Council rescind or withdraw the approval for the on- <br />sale Sunday intoxicating liquor license because one of the applicants is included on another <br />liquor license application in the City of Ramsey. Section 7.25.10 prohibits persons from <br />obtaining a liquor license if they have an interest in another liquor license establishment. <br /> <br />Motion by Councilmember Kurak, seconded by Councilmember Zimmerman, to rescind the on- <br />sale liquor license approval approved earlier in the evening to KBFC, Inc. as upon further review <br /> <br />City Council/August 28, 2001 <br /> Page 29 of 36 <br /> <br /> <br />
