He explained action is <br />taken against the business after the completion of the trial of the individual that sold the alcohol. <br /> <br />Case #5: <br /> <br />Request for Preliminary Plat and Site Plan Approval of Shade Tree <br />Cottages; Case of Shade Tree communities, LLC <br /> <br />City Attorney Goodrich reviewed that at the May 10, 2005 City Council meeting the Council <br />directed staff to attempt to contract all property owners affected by the Potassium Street right-of- <br />way acquisition. He advised the property owners have all been contacted. <br /> <br />Mayor Gamec noted for the record the City has received two letters of concern regarding this <br />development. The letters have been entered into the record and noted by the Council. <br /> <br />Community Development Director Trudgeon advised Case Nos. 5, 6, 7 and 8 are all related. He <br />indicated Shade Tree Communities, LLC has applied for preliminary plat and site plan review to <br />develop a residential Planned Unit Development (PUD) subdivision on the property generally <br />located along Potassium Street and east of Nowthen Boulevard. The subject property is 28 acres <br />in size and zoned R-1 Single Family. The preliminary plat is proposing to develop 16 single- <br />family lots and 26 single unit detached townhome units for a net density of 2.75 units per acre. <br />Single-family lots are permitted within the R-1 District and townhome units are permitted <br />through processing a PUD. He advised Rum River Estates is 10 acres in size and zoned R-1 <br />Single Family. The City Council will be reviewing the applicant's request to rezone the property <br />from R-I to PUD subsequent to this case. The request for a rezoning relates to the utilization of <br />townhomes within the development and to address deviations from City Code related to setbacks <br />and cul-de-sac length. <br /> <br />Community Development Director Tmdgeon advised staff has approached the property owners <br />on Potassium Street to work something out. The parties reluctantly agree that if Potassium Street <br />must be upgraded, that its right-of-way be split 33 feet on the Shade Tree Property and 33 feet on <br />their property. The WMO has indicated that any wetland impact should be avoided. He advised <br />a resolution is included in the Council's packet authorizing staff to begin acquisition of <br />permanent street and utility easements necessary for the improvement of Potassium Street. He <br />reviewed the following potential options for the Council to consider regarding intersection <br />upgrade options for both the south and north Old County Road 5 accesses. <br /> 1. Keep the general alignment of Potassium Street, cul-de-sac the southern Old Nowthen <br /> access onto Nowthen Boulevard, realign the northern Old Nowthen Boulevard to make a <br /> safer intersection. <br /> 2. Extend the Quicksilver Circle right-of-way to directly access Nowthen Boulevard, cul- <br /> de-sac the southern Old Nowthen access onto Nowthen Boulevard, realign the northern <br /> Old Nowthen access with Nowthen Boulevard to make a safer intersection. <br /> 3. Extend the Quicksilver Circle right-of-way to directly access Nowthen Boulevard, cul- <br /> de-sac both the southem and northem Old Nowthen access to Nowthen Boulevard <br /> <br />Councilmember Strommen clarified there is a reluctant agreement at best for a 33/33 split on <br />Potassium Street, but that will cause a problem with the WMO. <br /> <br />City Council / June 14, 2005 <br /> Page 8 of 29 <br /> <br /> <br />
