Commissioner Brauer stated he raised that question at the last meeting, and was told it should not
affect individual wells or systems. He indicated they have to depend on the expertise of those
that know these systems to approve the plan.

City Engineer Jankowski stated there are State well and septic codes that have to be followed, so
the system will be designed to those standards.

Ms. Finkfiner asked if the City has an idea on when sewer and water would be available to the
rest of the property.

Vice Chairperson Johnson indicated they really do not have a good idea.

Mr. Tomashevski asked how they could build a common septic system between developments.
He asked if there would be covenants to cover maintenance.

Vice Chairperson Johnson stated he assumes the City will review the legal requirements, but it is
possible for people to bind themselves legally to a common system. He indicated it would be a
contractual relationship between the developers and homeowner's associations and approved by
the City.

Commissioner Van Scoy stated as he looks at the proposed layout, the common septic system
appears to be landlocked.

Associate Planner Geisler stated they are proposing access from Wolverine.

Commissioner Van Scoy asked what happens to that land when the system is abandoned.

Associate Planner Geisler stated when sewer is available and the system is properly abandoned
the association would decide what to do with the land. She indicated it would belong to the
homeowner's association.

Mr. Sletner indicated it is a really odd shaped piece of land. He stated as the rest of Kelly Acres
becomes developed there will be extra run-off, and the thought was to use the land as a storm
water management facility for Kelly Acres.

Commissioner Van Scoy asked if a properly abandoned septic system would be an issue for use
as a storm water run-off.

City Engineer Jankowski indicated it would not.

Associate Planner Geisler stated the City would verify that if they approved any more
development on Kelly Acres.

P16

Planning Commission/June 2, 2005
