Councilmember introduced the following resolution and moved for its adoptiori: <br /> <br />RESOLUTION #05-07- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT <br />BASED ON FINDINGS OF FACT #0 AND DECLARING TERMS OF PERMIT TO <br />GRADE AND EXPORT SOILS . <br /> <br />30 <br /> <br /> WHEREAS, <br />Findings of Fact #0 <br />following conditions. <br /> <br /> the Ramsey City Council adopted Resolution #05-07-__ adopting <br />__ for this use and herein approves the Conditional Use Permit sul~ject to the <br /> <br />NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />on. July _, 2005; a Conditional Use Permit ("CUP") was issued by the City of Ramsey <br />("City") to Eric Thomsen ("Permit Holder") for grading operations on the property legally <br />described as follows: <br /> <br />That part of the Southwest Quarter of the Southwest Quarter of Section 2, Township 32, <br />Range 25, Anoka County, Minnesota, lying nogherly oflthe centerline of Trott Brooks, <br />subject to easement of record; .~ <br /> <br />-and- <br /> <br />The Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, <br />Anoka County, Minnesota, lying southerly of County Road #63. <br /> <br />("Subject Property:") <br /> <br />This permit is issued pursuant to Section 9.03.04 and 9.1.t8 of the Ramsey City Code. The <br />conditions of this permit are as follows: <br /> <br />1. This permit shall expire ninety (90) days from the date of approval of this permit. <br /> <br />2. The exporting of material shall be subject to the City Engineer's approval and <br /> contingent on the following: <br /> <br />Excavation area has been reshaped to a 4:1 slope. <br />All but a maximum 5 acre excavation area is established with turf (phasing plan). <br /> <br />3. A plan showing the finished elevations shall be submitted to the City Engineer for <br /> approval by November 1, 2005. <br /> <br />4. The grading operations shall be conducted in accordance with' the approved <br /> grading plan. <br /> <br />5. All equipment used for grading and hauling operations shall be maintained and <br /> operated in such a manner to minimize noise, dust, and vibrations adversely <br /> <br /> <br />
