everyone ends up paying more because it is not a level playing field. If Nextera
Communications wants to serve customers in Ramsey they should apply for a franchise.

Mayor Gamec stated anyone that comes in to provide this service should benefit all of the
residents in Ramsey, not just one segment. He inquired about the mile restrictions that were in
place when Comcast began servicing Ramsey.

Mr. Guz×etta replied the franchise area would be the same, and a build out schedule would be
discussed. Comcast had a period of years to build out, and he does not think it would necessarily
bc fair to require Nextera Communications to build out in the whole City in a time period of two
years.

Thc consensus of the Council was that Nextera Communications should be required to fall under
the fi'anchise requirements in the City of Ramsey.

Councihnember Elvig noted the Council has been concerned that when Town Center builds out,
the rest of the City should not be left behind in relation to roads, maintenance and other services.
The fi'anchise requirements fall in line with this concern.

Mr. O'Connell indicated the next response of the Cable Commission to Nextera
Communications will be to inform them of their requirement for a franchise.

Mr. Guzzetta advised this could potentially prompt a lawsuit from Nextera Communications.

MAYOR AND COUNCIL

None

ADJOURNMENT

Thc Work Session of the City Council was adjourned at 6:58 p.m.

Respectfully submjXte~

]me~.
