Mayor Gamec asked if the bank would be interested in the land if the building were to be moved. <br /> <br />Mr. Whelan replied perhaps, but the trees would likely need to be removed. <br /> <br />Councihnember Elvig noted the bank has indicated they would like to display some artifacts and <br />let some public use groups use the building. <br /> <br />MI'. Whelan indicated this would be done at no cost to the City. <br /> <br />Councihnember Elvig commented it cannot be assumed that the road issue can be fixed if the <br />building is moved. <br /> <br />Mayor Gamec noted the Council had also discussed the Historical Society taking over the <br />building. <br /> <br />The consensus of the Council was to direct staff to determine the costs associated with moving <br />and renovating the building, the details of the building being taken over by the Historical <br />Society, and the right-of-way issues in relation to the road issues associated with this area. <br /> <br />2) Nextera Communications <br /> <br />Assistant City Administrator Nelson advised Nextera Communications is a telecommunications <br />company that has installed utilities within the Town Center project area for the purpose of <br />delivering telephone, data and cable TV. Comcast is currently the only cable TV provider in the <br />City of Ramsey and has a current franchise with the City of Ramsey to provide those services. <br />Nextera Communications has requested to provide cable TV services within the Town Center <br />without a franchise, referencing provisions of state statute that exempts certain systems from the <br />fi'anchising requirements. The purpose of this discussion is to talk through the issues of why <br />OCTV and staff feel Nextera would be subject to franchising requirements. <br /> <br />Terry O'Connell, Executive Director of QCTV, stated Comcast has a franchise with the City of <br />Ramsey, and Comcast has met the requirements of that franchise. Further, state and federal <br />government requires the City to have a level playing field. He stated the Cable Commission has <br />a stated goal for 2005 to actively try to seek competition, which will be good for the consumers, <br />but this must be done by the letter of the law. <br /> <br />Stephen Guzzetta, Attorney representing QCTV, advised Nextera Communications is asking to <br />provide video service to residents in Town Center, and not to any other portion of the City. He <br />provided the Council with a legal review of the franchising requirements per state and federal <br />law. <br /> <br />Councihnember Olson stated she has an extensive background in dealing with companies that <br />come in and choose the cream of the crop, and she is absolutely against allowing this to happen. <br />These companies do nothing but add a financial burden to companies that serve everyone, and <br /> <br />City Council Work Session / June 14, 2005 <br /> Page 3 of 4 <br /> <br /> <br />
