<br /> <br />Councilmember Musgrove asked if a Conditional Use Permit follows the property or landowner. <br /> <br />Senior Planner McGuire Brigl replied that a CUP would follow the land, if granted. <br /> <br />Councilmember Musgrove stated that staff indicated that applications were not found granting that <br />CUP but there was language in the case stating that if the applicant can provide that proof this <br />would come back to the Council. <br /> <br />Senior Planner McGuire Brigl stated that with the correct documentation the City would need to <br />review the rights of the property. She stated that from the perspective of the City and the notices <br />that would be mailed, 28 days would be provided to the applicant. <br /> <br />Motion by Councilmember Woestehoff, seconded by Councilmember Howell, to Adopt <br />Resolution #21-112 Stating the Extent of Lawful, Nonconforming Rights at 14300 Sunfish Lake <br />Boulevard NW. <br /> <br />A roll call vote was performed: <br /> <br />Councilmember Heineman aye <br />Councilmember Woestehoff aye <br />Councilmember Specht aye <br />Councilmember Musgrove aye <br />Councilmember Howell aye <br />Councilmember Riley aye <br />Mayor Kuzma aye <br /> <br />Motion carried. <br />nd <br />7.06: Adopt Resolution #21-115 Approving an Abatement of 7471 152 Avenue NW <br /> <br />Senior Planner McGuire Brigl reviewed the staff report and recommendation to adopt the <br />nd <br />resolution approving an abatement at 7471 152 Avenue NW to remove items in violation of City <br />Code including lawnmowers, machinery parts, and other refuse items from the property. The cost <br />of the work will be assessed to the property taxes for the subject property. <br /> <br />Councilmember Howell asked if third notices are sent out. <br /> <br />Senior Planner McGuire Brigl stated that third notices are sent out if the property owner has <br />reached out and was attempting to work with staff. <br /> <br />Councilmember Woestehoff asked if the property has a second driveway and whether that is <br />allowed by Code. <br /> <br />Senior Planner McGuire Brigl commented that this district would allow two driveways with a <br />driveway permit, noting that permit has not been obtained. <br />City Council / May 11, 2021 <br />Page 17 of 20 <br /> <br />
