Staff solicited quotations and arranged for a contractor to install the drain tile and remove <br />the two trees. The contractor was successful in installing the drain tile; however, the <br />Pugh's would not allow access to their lot to remove, the trees. Staff met with them and <br />the decision was made that they could hire their own tree removal service and would be <br />reimbursed up to $1500.00, this was the quote received by the City for the work. Staff <br />for~varded the payment with the attached letter after the invoice was received. This was <br />to be the extent of the City involvement on this lot. The work was charged to the <br />developer's escrow. The work was performed in November 2004, just before freeze up. <br />The escrow expired in the spring of 2005. <br /> <br />Staff received the attached letter from Jay and Cindy Pugh, 5518 144th Court, this spring. <br /> <br />The developer, Royal Oaks Realty, and the builder, Shade Tree Construction, did not <br />issue formal replies to the letters sent last fall. <br /> <br />Options: <br /> <br />The hole left by the removal of the trees is within the drainage and utility easement. Staff <br />has prepared some solutions listed below in increasing level of disturbance. <br /> <br />Provide several loads of topsoil for the Pugh's to use to fill the hole. They <br />would be responsible for moving and placing the material and establishing the <br />sod. This would address the deep hole problem, there could still be ponding <br />on the lot after rain events. <br /> <br />Fill the hole and reestablish the drainage swale on the common lot line <br />between Lot 24 and Lots 6, 7 & 8. The drainage and utility easement is 20 <br />feet Wide. This would require removal of the existing fences, lowering the <br />grade and re-establishing the sod. Work would also be required along the line <br />between Lots 23 and 24. This would establish the drainage patterns per the <br />approved grading plan in the drainage and utility easements. Work would be <br />required outside the drainage and utility easements to blend the new grades <br />into existing grades and remove the potential ponding areas. The fences <br />would be replaced; the back yards will now have swales. This Would be a <br />City administered project. Temporary access easements would be required as <br />the lot line between 23 & 24 is too steep for equipment access. <br /> <br />Perform the work listed above as a private project without City involvement. <br />Access arrangements would be required from all of the affected property <br />owners. <br /> <br /> <br />
