Recommendation:

State law precludes holding up new building permits for contractors that have outstanding
issues on completed projects, so the City does not have a means to require the contractor
to address the situation through the building permit process.

The best solution would be resolution of the problem by the builder. The next option
would be number two, the source of the funding could be the storm water utility. Option
one would address the deep hole issue raised in the letter but will not address the
underlying drainage issues.

All parties must sign an agreement stating the expectations, terms and conditions related
to the work prior to undertaking the corrective measures.

Staff will present estimates for each option at the meeting.

Action:

Motion to recommend to the City Council a plan of action based on discussion.

Reviewed By:
Assistant Director of Public Works/Principal City Engineer

PW:' 07/26/05
