When mining operations are anticipated to be discontinued for an interval greater than one working day, the slopes shall be flattened to a grade no steeper than 4 feet horizontal to 1 foot vertical.- 13. [~rior to commencing any grading operations, a cash escrow or letter of credit approved as to form by the City in the amount of Ten Thousand Dollars and no cents ($10,000.00) shall be deposited with the City. This financial guarantee may be used by the City to pay for the cost and expense of repairing any public right of ways or regrading and stabilizing eroded areas due to the grading operation, pay fbr any cost associated in administering the requirements of this Chapter of the City Code, and to pay for any restoration of the work site not properly restored upon completion. The Permit Holder agrees to permit access to the property by the City to facilitate restoration, if necessary. 14. The Permit Holder shall implement sediment and erosion control practices. No grading activity shall occur within twenty-five (25) feet of a property line unless silt fence is placed along the property line to prevent sediment from washing onto thc adjoining property. Any erosion which causes gullies of greater than one (1) foot within twenty-five (25) feet of a property line shall be regraded within forty- eight (48) hours of the precipitation event that caused the erosion. 15. There shall be no stockpiling of graded materials, other than the topsoil on a temporary basis, allowed within the boundaries of the Subject Property. 16. The permit holder shall file with the City a liability insurance policy or certificate of such insurance acceptable to the City and issued by an insurance company authorized to do business in the State of Minnesota. 17. The policy shall insure the permit holder for the sum of at least $300,000 for injury to one person and $500,000 for one accident, and at least $1,100,000 property damage. 18. Said policy shall be for the full period of the permit and shall provide for the giving of 30 days prior notice to the City by registered mail of termination, cancellation or amendment of the policy. 19. In the event said policy is terminated for any reason, the permit shall be automatically suspended upon the day the policy terminates unless a new policy complying with this item is obtained and filed with the City prior to the termination of the policy in force. 20. The maximum noise level at the perimeter of the work site shall be within the limits set by the Minnesota Pollution Control Agency and the Environmental Protection Agency of the United States.
