When mining operations are anticipated to be discontinued for <br />an interval greater than one working day, the slopes shall be flattened to a grade <br />no steeper than 4 feet horizontal to 1 foot vertical.- <br /> <br />13. [~rior to commencing any grading operations, a cash escrow or letter of credit <br /> approved as to form by the City in the amount of Ten Thousand Dollars and no <br /> cents ($10,000.00) shall be deposited with the City. This financial guarantee may <br /> be used by the City to pay for the cost and expense of repairing any public right of <br /> ways or regrading and stabilizing eroded areas due to the grading operation, pay <br /> fbr any cost associated in administering the requirements of this Chapter of the <br /> City Code, and to pay for any restoration of the work site not properly restored <br /> upon completion. The Permit Holder agrees to permit access to the property by <br /> the City to facilitate restoration, if necessary. <br /> <br />14. The Permit Holder shall implement sediment and erosion control practices. No <br /> grading activity shall occur within twenty-five (25) feet of a property line unless <br /> silt fence is placed along the property line to prevent sediment from washing onto <br /> thc adjoining property. Any erosion which causes gullies of greater than one (1) <br /> foot within twenty-five (25) feet of a property line shall be regraded within forty- <br /> eight (48) hours of the precipitation event that caused the erosion. <br /> <br />15. There shall be no stockpiling of graded materials, other than the topsoil on a <br /> temporary basis, allowed within the boundaries of the Subject Property. <br /> <br />16. The permit holder shall file with the City a liability insurance policy or certificate <br /> of such insurance acceptable to the City and issued by an insurance company <br /> authorized to do business in the State of Minnesota. <br /> <br />17. The policy shall insure the permit holder for the sum of at least $300,000 for <br /> injury to one person and $500,000 for one accident, and at least $1,100,000 <br /> property damage. <br /> <br />18. Said policy shall be for the full period of the permit and shall provide for the <br /> giving of 30 days prior notice to the City by registered mail of termination, <br /> cancellation or amendment of the policy. <br /> <br />19. In the event said policy is terminated for any reason, the permit shall be <br /> automatically suspended upon the day the policy terminates unless a new policy <br /> complying with this item is obtained and filed with the City prior to the <br /> termination of the policy in force. <br /> <br />20. The maximum noise level at the perimeter of the work site shall be within the <br /> limits set by the Minnesota Pollution Control Agency and the Environmental <br /> Protection Agency of the United States. <br /> <br />Resolution #05-07- <br /> Page 3 of 5 <br /> <br /> <br />
