21. All costs incurred by the City in executing and administering this permit shall be the responsibility of the permit holder. The permit holder shall maintain a minimum Five Hundred Dollar ($500.00) balance in an escrow account with the City. This escrow shall be used to reimburse the City for expenses incurred in the administration of this permit. At the time the mining operation and site restoration are completed to the satisfaction of the City, the balance of the escrow shall be returned to the Permit Holder. 22. All grading operations shall be conducted between 7:00 a.m. and 8 p.m. on weekdays only unless otherwise specifically approved by the City Administrator and/or his designee. 23. The amount of dust or other particulate matter caused by the mining operation shall not exceed the standards established by the Minnesota Pollution Control Agency. No operation shall be allowed when wind gust exceeds 30 miles per hour. 24. All operations shall comply with all applicable Minnesota Pollution Control Agency regulations and Federal and Environmental Protection Agency regulations for the protection of water quality.
