The proposed Landscaping Plan is generally acceptable with some minor modifications. No tree <br />preservation plan is required as the site is void of trees. <br /> <br />The Master Development Agreement for Town Center establishes that there are no park or trail <br />f~cs clue on this plat. However, there is a park payment obligation in the 1st Amendment to the <br />Master l)cvelopment Agreement that requires a cash payment, to the City, upon sale of the <br />property in an amount equal to $750.00 times the number of eligible units on the property in <br />accordance with the zoning regulations. <br /> <br />l"inally, Staff is still in the process of drafting a Development Contract for the l0th Addition. A <br />copy will bc available for Council review at the meeting. <br /> <br />Recommendation: <br /> <br />Staff is recommending approval of the request for final plat and final site plan approval <br />contingent on compliance with the following: <br /> <br />1. Compliance with City Staff Review Letter dated July 22, 2005 <br />2. Thc Developer entering into a Development Contract with the City <br />3. Approwd of the request for Comprehensive Plan Amendment from the Metropolitan Council <br />4. Approval of the request for easement vacation on the Subject Property <br />5.
