CC Regular Session 7, 6, <br />Meeting Date: 07/27/2021 <br />By: Brian McCann, Community <br />Development <br />Information <br />Title <br />Adopt Resolution #21-216 Approving an Abatement of 7009 Highway 10 NW <br />Purpose/Background: <br />Planning is seeking authorization to abate a trailer and plow truck in violation of City Code at 7009 Highway 10 <br />NW. The Subject Properties have off-street parking violations. The Property Owner has not been compliant with <br />Staff requests to move the plow truck to a proper surface, and remove the trailer being utilized as a storage shed. <br />Notification: <br />No notification is required. <br />Observations/Alternatives: <br />Summary <br />The Subject Properties are located at 7009 Highway 10 NW, and consist of two (2) parcels along Highway 10. The <br />Subject Properties are zoned H-1 Highway 10 Business District and are approximately 1.65 acres in size in total. <br />Abutting properties to the east and west of the Subject Properties are zoned the same and are City -owned properties. <br />The Property has had code enforcement cases since 2004 concerning off-street parking violations directly related to <br />the trailer on site. Staff recently sent a first notice of violation on July 9, 2021. The Property Owner has stated they <br />will not be adhering to the requests of the notice of violation, and are seeking legal counsel related to the <br />grandfather rights of the trailer and plow truck. <br />Code Enforcement Actions <br />• There are documented off-street parking violations dating back to 2004 including the trailer parked on the <br />grass. <br />• Staff had previously requested the removal of the trailer and relocation of the plow truck, but were <br />sympathetic to the Business' needs during the COVID-19 pandemic. <br />• A first notice of violation was sent to the Property Owner on July 9, 2021 requesting the removal of the <br />trailer and the relocation of the plow truck. <br />• The Property Owner stated in two (2) phone calls on July 15, 2021 and July 20, 2021 that they would not be <br />moving the trailer or plow truck from the grass and they would be seeking legal counsel. <br />• The City is requesting abatement of the trailer and plow truck from the City Council on July 27, 2021. The <br />abatement would take place fourteen (14) days after the meeting, supplying the Property Owner with a notice <br />of abatement. <br />Funding Source: <br />Staff handles all Code Enforcement cases as part of their regular duties. <br />Recommendation: <br />Staff recommends adopting Resolution #21-216 Approving an Abatement of 7009 Highway 10 NW <br />Action: <br />
