WHEREAS, the City Council authorized abatement of the Subject Properties at their <br />regular meeting on July 27, 2021; and <br />FINDINGS OF FACT <br />1. The City inspected the property from the road on: <br />a. July 9, 2021. <br />2. The City sent formal notices via US Mail on: <br />a. July 9, 2021 for a first notice of violation requesting the trailer be removed and all <br />vehicles be placed on appropriate surfacing. <br />3. The City discussed the code enforcement case with the Property Owner on: <br />a. July 15, 2021 regarding the status of the trailer and plow truck. The Property <br />Owner stated he would seek legal counsel if necessary regarding grandfathered <br />rights of the trailer and plow truck. City Staff relayed that they would verify <br />grandfathered rights pertaining to the vehicles and return their call. <br />b. July 20, 2021 to relay that City Staff believes there are not any legal, <br />nonconforming rights related to grass parking for the trailer or plow truck. The <br />Property Owner stated they would be contacting their attorney and they would not <br />be open to a meeting with City Staff. <br />NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />That the Ramsey City Council hereby grants approval of the proposed code enforcement action <br />plan on the Subject Properties as outlined below, contingent upon verification of any violation(s) <br />of City Code: <br />1. The City of Ramsey shall utilize Northstar Towing and Reshetar Systems Inc. for <br />abatement services per City policy. <br />2. That the week of August 11, 2021, the City of Ramsey will work with abatement <br />contractors listed above to tow the trailer and plow truck from the Subject Properties. <br />3. That future violations within twelve (12) months of the same type will result in financial <br />penalties and quicker escalation of violation notices. <br />4. That the City Council reserves the right to escalate future violations directly to District <br />Court for Temporary Restraining Order. <br />5. That if the Property Owner misses one of the aforementioned deadlines, Staff has the <br />approval to: <br />RESOLUTION #21-216 <br />Page 2 of 4 <br />
