CLIENTELE/MEETINGS Dave is currently city attorney for the cities of Clearwater (2020), Maple Lake (2019), Wahkon (2019), Holdingford (2019) and Franklin (2018), general counsel for the Bassett Creek Watershed Management Commission (2018), and assistant city attorney for numerous Minnesota cities, including Hopkins, Maplewood, Woodbury, Oakdale, Medina, Mounds View, New Prague, and Faribault. Dave is available on the second and fourth Tuesday of every month for city council meetings, and he is also available for Wednesday officer hours, as requested in the city's RFP. MUNICIPAL LAW EXPERIENCE Dave's day-to-day practice is concentrated in general municipal law, including, but certain not limited to, land use matters, public contracting, real estate, data practices, economic development and redevelopment, and code enforcement. Dave's representation of cities includes numerous appearances before trial and appellate courts within the state on various issues. Recently, Dave brought a successful lawsuit for specific performance against an area landowner who breached a purchase agreement with a client city. While Dave does not focus his practice on litigation, he has also handled lawsuits regarding hazardous properties, special assessment challenges, and public nuisances. Dave has represented cities in a broad range of land use and planning matters. Dave also uses his experience at the county level to navigate the complex interaction of local laws and other regulations with respect to land use issues. He has advised cities on issues related to general development activity, zoning code reviews and recodifications, and a host of other land use, planning, development, and real estate matters. Dave is extensively involved with development -related work throughout the metro area, including in both Woodbury and Medina, and regularly works alongside staff from said cities to facilitate development activities. Dave has experience drafting and reviewing numerous types of agreements for city clients. Aside from traditional development and redevelopment agreements, Dave also has experience drafting and revising standard form agreements prepared for construction contracts, including AIA and EJCDC documents, and professional services agreements. Dave has also drafted employment agreements for city employees and a broad range of other agreements which have been proposed to cities. Lastly, Dave has significant experience with drafting and reviewing ordinances and resolutions for municipal clients, including working with numerous cities on very extensive recodification projects. While Dave has also worked with municipal clients on personnel and other employment -related matters, there are other attorneys at the firm that specialize in municipal employment law who are always willing and available to assist our city attorney clients, as necessary.
