There will be 234 new homes, The <br />City Council has already approved the preliminary sketch plan. They talked about a lot of <br />meetings going on and the Planning Commission recommended the Council deny the Comp Plan <br />amendment and sketch plan review but the City Council elected to not take the recommendation <br />of the Planning Commission and approved it. We feel we have a peaceful City but we will not <br />have a peaceful City for very long, He felt that the residents are entitled to peace. <br /> <br />Mr. Zactsch stated that Mr. Deemer talked about the MUSA - the whole portion of leapfrogging <br />is because the MUSA line has been abandoned. <br /> <br />Commissioner Deemer stated there have been many attempts in the past to stop the MUSA line. <br /> <br />Mr. Goodrich stated that the MUSA line has to do with the Met Council. <br /> <br />Councihnember Elvig stated that the Metropolitan Council put together a 2020 blueprint for the <br />M[JSA line. They are drawing lines down streets - someone on the south gets a value - the <br />north docs not. Now it is up to City officials where the MUSA can go. Now we will get a <br />petition for municipal facilities. That's why there was a change and not a definite MUSA line <br />any more. Councilmember Elvig continued that this petition came out after we motioned to have <br />hook up fees eliminated. We had to wait 30 days in case it would be contested. There is no <br />mandatory hook up - that's a protection already in place, <br /> <br />Commissioner LaMere stated that some things can be done with just ordinance changes, In <br />revicwing the content for constitutionality and legality - this may not even be a Charter issue. <br /> <br />Mr. Hendriksen stated this did not happen over night. The City Council has been talking about <br />repealing these ordinances for five years. They finally did it at the time this petition was <br />happening, He did not think that was a coincidence. <br /> <br />Commissioner Bertzyk stated that we should wait until there is more information - this may all <br />be null and void. <br /> <br />Commissioner LaMere asked about the timeline for acceptance. <br /> <br />Co~nmissioner Deemer stated he feels the date line should not have started until the Charter <br />Commission reviews the petition and sends it to the Council. <br /> <br />Chairperson Vogt stated that has to do with State Statutes, <br /> <br />Commissioner Deemer stated that State Statute has changed a lot in the last year. <br /> <br />Chairperson Vogt stated the City has a paid lawyer on staff who says this is the way it is in the <br />State Statues, <br /> <br />Attorney Goodrich added that the Charter Commission meets sporadically. <br /> <br />Charter Commission - April 21, 2005 <br /> Page 6 of 10 <br /> <br /> <br />
