Bob }lamborg stated it is not too difficult to get over 800 signatures. If we had another couple of <br />weeks, we would have over 1,000 signatures. Citizens do not want City sewer and water and <br />they do not want leapfrogging! <br /> <br />Comlnissioner Bertzyk stated it's speculation - it's a fear tactic, it's not a fact. She was told by <br />someone that they didn't get to read the petition - they got an interpretation of it which can be <br />swayed <br /> <br />Mr. Zaetsch stated he gave a woman 25 minutes to read the petition. <br /> <br />Commissioner LaMere stated that she is still unclear on the escrow account and how it gets set <br />up. Shc did not know if it's legal and if it should be in the Charter. It sounds like this petition <br />and the newly adopted ordinance crossed and that's unfortunate. She wondered if there is a way <br />to rescind the petition and then stated that right now it's a wait and see. <br /> <br />Mt'. ttendriksen stated that some of us believe the ordinance would never had been passed if it <br />weren't for this petition. Also, the City already has a way to track the escrow funds. Even with <br />sections rescinding, individuals are better protected under this. He added that if the petition <br />prcscntcrs were misleading, they could put it on the ballot. <br /> <br />Chairperson Vogt stated that a portion in the Charter talked about getting 100% signers for a <br />petition for a project. <br /> <br />Mr. Goodrich stated that 50% is the valid number to start the process. <br /> <br />Chairperson Vogt added that the Commission needs to wait to hear from Mr. Goodrich with <br />regard to the legalities. Therefore, another Charter Commission meeting needs to be set. <br /> <br />Commissioner Deemer stated that he does not think the "clock" should have started. <br /> <br />Corem issioner Frederick asked if the Charter Commission should be meeting before the Council. <br /> <br />Mr. Goodrich responded that the City Council will clearly make the decision of the legality of <br />this language. <br /> <br />Commissioner Simenson stated that the City Council will follow the legal position. <br /> <br />Mr. Goodrich stated that the City Council sets the ballot question. The Charter's most important <br />input on this is to review the language and collectively give a position on it. <br /> <br />Commissioner Bertzyk inquired what the Charter could accomplish if they cannot change any <br />words. <br /> <br />Chairperson Vogt stated that they will be able to speak on the Charter. <br /> <br />Charter Commission - April 21, 2005 <br /> Page 8 of 10 <br /> <br /> <br />
