Mr. Goodrich stated that the City Council has strict State law to follow- and added that the <br />Charter meeting after the Council receives the opinion is fine. <br /> <br />Commissioner Frederick thought it was better to be heard - giving a recommendation to the City <br />Council. <br /> <br />Mr. Goodrich stated that the City Council will still hear about that. <br /> <br />('~hairpcrson Vogt stated that if we say we do not agree with this amendment, as this becomes <br />more public, thc fact that the Charter either agrees or disagrees can be put out before the vote. <br /> <br />Mr. Goodrich replied absolutely - that's why the Charter would want to meet before the election. <br /> <br />Mr. i tcndriksen stated that if the Charter Commission agrees with the proposed amendment, they <br />could recommend the City Council adopt it by ordinance. <br /> <br />Motion by Commissioner Deemer and seconded by Commissioner Simenson that the time has <br />not started - thc Charter Commission has not sent it to the City Council which would be the start <br />of the clock. <br /> <br />Further discussion: Commissioner LaMere inquired if 410.12; Subdivision 3 is where <br />Commissioner Deemer is getting his information. Mr. Hendriksen stated that because of not <br />holding regular meetings, the Charter Commission could actually hold things up for a year and a <br />half. Mr. Goodrich expressed disagreement with Commissioner Deemer's comment relating to <br />the clock starting. <br /> <br />Second to the motion was withdrawn by Commissioner Simenson. He stated that he would agree <br />with the City's licensed legal counsel. <br /> <br />Motion failed for lack of a second. <br /> <br />Consensus of the Charter Commission was to meet on May 12, 2005, to discuss the proposed <br />amendment. <br /> <br />Case #1: Appoint Chair and Vice Chair for Commission <br /> <br />Motion by Commissioner Ebel and seconded by Commissioner Frederick to appoint Tim Vogt to <br />the position of Chair of the Charter Commission. <br /> <br />Motion carried. Voting Yes: <br />Simenson. Voting No: None. <br />and Swanson. <br /> <br />Commissioners Ebel, Frederick, Bertzyk, Deemer, LaMere and <br />Abstain: Chairperson Vogt. Absent: Commissioners Fischer <br /> <br />Motion by Commissioner Ebel and seconded by Commissioner Frederick to appoint Hannah <br />I,aMere to the position of Vice-Chair of the Charter Commission. <br /> <br />Charter Commission - April 21, 2005 <br /> Page 9 of 10 <br /> <br /> <br />
