6)

Report on Meeting with Mallard Estates Townhome Association Regarding the
Removal of the Argon Street Gated Access

Assistant Public Works Director Olson indicated on June 9, 2005 Chief Way and City Engineer
Jankowski met with the three member board of the Mallard Estates Townhome Association to
discuss the issue of removing the gated access across Argon Street. After significant discussion,
the Townhome Association suggested a narrow passage and that improvements be made to the
appearance of the existing gate area. At the end of this meeting it was agreed that the City would
respond with a specific proposal for remodeling of this access point that the board could present
to their members. Such a proposal should include a visual rendering which would emphasize the
aesthetics of the proposal. Ultimately staff would like to have the ability to hire a landscape
architect to c(?mplete a visual rendering to bring back to the board. The cost to hire a landscape
architect to prepare a drawing to present to the neighborhood would be a minimum of $1,000.

Assistant Public Works Director Olson advised the Committee discussed the following issues
associated with this access:

· The access being used as an emergency access
· Whether the access needs to be wide enough for two way traffic, especially with the
improvements planned on CR 116
· Tying this access in with the closing of 142nd Avenue

Assistant Public Works Director Olson indicated the Committee motioned to table the action to
open the gate at Mallard Ponds until one month after the construction of CR 116 is complete and
to direct staff to continue discussions'with the Mallard Ponds Association regarding the potential
of landscaping for a roadway that is a minimum of 24 feet in width.

Motion by Councilmember Elvig, seconded by Councilmember Cook, to ratify the
recommendation of the Public Works Committee for Case Nos. 3 and 6 and to authorize that' the
street signs be changed as petitioned by the residents on Old County Road 5 and that 911
officials be notified of the change contingent on review by the City Attorney; and to table the
action to open the gate at Mallard Ponds until one month after the construction of CR 116 is
complete and' to direct staff to continue discussions with the Mallard Ponds Association
regarding the potential of landscaping for a roadway that is a minimum of 24 feet in width.

Motion carried.
