grading and drainage is acceptable. The utility plan will need to be reviewed in accordance with <br />the comments outlined in the Staff Review Letter. He advised the project area includes a large <br />wetland that spans several lots throughout the development. The wetland is being encumbered <br />with thc required drainage and utility easement. The grading plan shows a portion of the wetland <br />being filled in order to create enough area for a building pad. The grading plan shows mitigation <br />areas to replace the proposed wetland fill area. The applicant has received a permit from the <br />l Jower Rum River Watershed Management Organization and will need to adhere to the terms of <br />that permit. He advised staff recommends approval of the final plat subject to compliance with <br />City Staff Review Letter dated July 22, 2005 and the applicant entering into a Development <br />Agreemcnt with the City. <br /> <br />Counci hnember Elvig stated he is pleased with this project and the mitigation factor. <br /> <br />Motion by Councilmember Elvig, seconded by Councilmember Jeffrey, to approve the final plat <br />lbr Ramscy Meadows 5th Addition; Case of TMH Development, contingent upon compliance <br />with lhc City Staff Review Letter dated July 22, 2005 and the applicant entering into a <br />I)cvclopmcnt Agreement with the City. <br /> <br />Motion carried. Voting No: None. <br /> <br />Case #13: <br /> <br />Request for Final Plat Review of Marigold Pond, Case of Oakwood Land <br />Development <br /> <br />Community Development Director Trudgeon stated Oakwood Land Development has applied for <br />final plat review to develop 92 urban single family residential lots on the property generally <br />located on ttighway 47 at 160th Lane NW. The property is currently located in the R-1 Rural <br />l)evcloping District, with a minimum density of one lot per 2.5 acres. On June 28, 2005 the City <br />Council approved a Comprehensive Plan Amendment request for the subject property; staff has <br />sent the request to the Metropolitan Council for review; this approval is still pending and <br />approval tonight would be contingent on the City receiving that approval from the Metropolitan <br />Council. He advised the net density allowed under R-1 zoning is three units per acre. The final <br />plat reflects a net density of 2.03 units per acre, not including wetlands. All of the proposed lots <br />meet urban single-family standards for lot width, size, and frontage on a public road. <br /> <br />Mr. Trudgeon indicated there are substantial wetlands on the proposed plat. The applicant is <br />voluntarily showing a 10-foot wetland buffer on the final plat, which is not yet required by City <br />Codc. Staff will be working with the applicant on installing monuments along the buffer edge. <br />Somc revisions to the grading, drainage, and utilities plans are required per the City Staff Review <br />I;ettcr. The development has received approval from the Lower Rum River Water Management <br />Organization (LRRWMO). The final plat is proposing to fill 0.1 acres of wetland to construct <br />Lithium Street, which has been approved by the LRRWMO. He advised current City Code <br />requircs density transitioning between the project area and adjacent rural size lots. There is <br />significant tree cover on the site that staff feels combined with the wetland area and new <br />landscaping will largely satisfy density transition requirements on the site. <br /> <br />City Council / July 26, 2005 <br /> Page 19 of 35 <br /> <br /> <br />
