Mr. Trudgeon indicated the final plat proposes to provide public access from Highway 47 at <br />160th l Jane NW, and to connect to 162nd Avenue NW to the east. A stub street is shown to <br />provide access to the north at a future date. MnDOT has provided comments on the proposal and <br />will require both north and south turn lanes into the development. Their letter also indicates that <br />MnDOT will not be responsible for any noise mitigation measures needed for highway noise. <br />Thc applicant is proposing a combination of landscaping, berming, and fencing along Highway <br />4.7; staff' is requesting additional information on proposing landscaping for the berms. He <br />advised a traffic generation analysis has been prepared for the proposed plat. As expected, the <br />proposed development will add traffic to Highway 47. An acceptable level of service will be <br />maintained on Highway 47, with the exception of the intersection with CR 116, which is already <br />at an unacceptable level of service. <br /> <br />Mr. Trudgeon advised the Park Commission met in joint session with the City Council on June <br />9th and reviewed the preliminary plat for Marigold Pond. The Park Commission recommended <br />allowing the trail on Highway 47 to veer into the plat north of 160th Lane, and back to the <br />I Iighway 47 right-of-way at the northern boundary of the plat. Some minor changes are required <br />to thc trail alignment near the proposed underpass. The Commission recommended cash <br />payment for park and trail fees, with a possible reduction if an east-west trail easement can be <br />accommodated within the plat. There is a large wetland area on the east side of the plat that <br />makes such a connection difficult. Staff thought if the Boy Scout camp develops in the future, <br />that area might be more appropriate to accomplish that east-west trail connection. He advised <br />staff' recommends approval of the request for final plat. <br /> <br />Councihnember Strommen stated she received a call from a property owner to the east with <br />concerns about dewatering and potential overflow from drainage ponds. She would like to be <br />certain staff has reviewed any dewatering plans. <br /> <br />City Engineer Jankowski replied staff has had experience dewatering this area in the past and is <br />confident it can be done without impacting those properties. <br /> <br />Councihnember Elvig stated there is no plan for the Boy Scout camp to be developed. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Pearson, to adopt Resolution <br />#05-07-236 to approve the final plat of Marigold Pond contingent upon compliance with the City <br />Staff Review Letter dated July 22, 2005, the Developer entering into a Development Agreement <br />with thc City, and approval of the Comprehensive Plan Amendment request by the Metropolitan <br />Council. <br /> <br />Further discussion: Councilmember Cook stated this developer has been very cooperative, and <br />has allowed a trail to go along Highway 47. <br /> <br />Motion carried.
