Counci lmember introduced the following resolution and moved for its adoption: RESOLUTION #05-08- RESOLUTION ADOPTING FINDINGS OF FACT REGARDING MAKING A DETERMINATION THAT AN ENVIRONMENTAL IMPACT STATEMENT (EIS) IS/IS NOT NEEDED FOR BROOKFIELD ADDITION WHEREAS, Oakwood Land Development, hereinafter referred to as "Developer", has properly applied for a preliminary plat to develop 156 acres on the property located within the City of Ramsey as shown on Attachment A (the "Subject Property"); and WHEREAS, under 4410.4300(19)(c)of the State of Minnesota' Rules, the subdivision proposed by the Developer is required to have an Environmental Assessment Worksheet (EAW) prepared. NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to thc request are determined to be as follows: 1. ri'hat on June 13, 2005, the City of Ramsey released the Draft EAW for the Brookfield Addition development; and 2. That on June 17, 2005, public notice on the availability of the Draft EAW appeared in the Anoka County Union. 3. That on June 20, 2005, public notice on the availability of the Draft EAW appeared in the State of Minnesota Environmental Quality Board's publication the EQB Monitor. 4. That the Draft EAW was sent to the following agencies for review and comment: U.S. Army Corps of Engineers U.S. Environmental Protection Agency U.S. Fish & Wildlife Services Board of Water and Soil Resources Minnesota Department of Agriculture Minnesota Department of Health Minnesota Department of Natural Resources Minnesota Department of Transportation Minnesota Environmental Quality Board Minnesota Historical Society Minnesota Pollution Control Agency Metropolitan Council Anoka County
