Abstain: Councilmember Elvig. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Jeffrey, to adopt Resolution #05- <br />07-233 approving the request for an interim use permit based on findings of fact. <br /> <br />Motion carried. Abstain: CouncilmemberElvig. <br /> <br />Case #9: <br /> <br />Request for a Conditional Use Permit to Grade and Export Soils; Case of <br />Eric Thomsen <br /> <br />Assistant Community Development Director/Executive HRA Director Frolik explained the City <br />has received an application from Eric Thomsen to renew a Conditional Use Permit to grade and <br />export soils from his property at 6210 Green Valley Road. The subject property consists of 63 <br />acres, 9 of which have been subject to a grading permit since 2000. The City Council issued a <br />Conditional Use Permit for grading and mining activities to Eric Thomsen in 2000. That permit <br />expired in 2002. The City Council renewed the Conditional Use Permit in 2002 and that permit <br />expired in June 25, 2005. Mr. Thomsen and his contractor estimate that it will take <br />approximately 90 days to complete the grading and mining plan approved in 2000. Therefore, <br />Mr. Thomsen is applying for a 90 day renewal of the grading and mining Conditional Use <br />Permit. <br /> <br />City Engineer Jankowski indicated the City Engineering Department inspected the site on July 1, <br />2005. The main concern is that the site be properly restored after it is mined. The site has <br />basically been excavated in the manner proposed with the prime concern in protecting Trott <br />Brook to the south. There were some concerns with regard to the final slope. The Planning <br />Commission recommended approval of the 90 day permit, noting that no further exporting of <br />soils may occur until the issues resulting from the Engineering inspection have been resolved. <br />There has been additional grading work done since July 1st, and Mr. Thomsen has indicated he <br />will be seeding additional areas tomorrow. Part of the problem has been that in the last two <br />weeks they have been unable to make a site visit together. He indicated they will get together <br />within the next couple of days to see if Mr. Thomsen can be authorized to remove material from <br />the site. <br /> <br />Ms. Frolik indicated the permit states there will be no more exporting of material until all of the <br />issues have been resolved. <br /> <br />Mayor Gamec questioned if 90 days will be enough time to complete the grading and mining. <br /> <br />Eric Thompson, applicant, replied the contractor that has control of the site has assured him it <br />can be done by the end of September, and this deadline will apply pressure to complete the work. <br /> <br />Councilmember Elvig stated staff's recommendation to keep the materials on the site until the <br />final outcome is excellent.
