Irrigation rain sensors shall be installed and appropriately placed throughout the <br /> development. <br /> <br />("P, cquired Improvements)". <br /> <br />FIR E LANES. Fire lanes shall be maintained on the Site~, The exact location of these items on <br />thc Site shall be as directed by the City's Fire Chief. <br /> <br />LIGHTING. Lighting shall be installed on the site in accordance with City Code. <br /> <br />BUILDING FACADE. The Permittee agrees to construct all building faces of the same <br />material as listed on the Building Elevations prepared by CM Architecture dated July 5, 2005, <br />revised August 12, 2005. <br /> <br />REQUIREMENTS FOR BUILDING PERMIT. No building permit for the Site will be <br />issued until the Permittee has: a) signed and returned this Development Permit, b) the City has <br />received the required financial surety, inspection fees, and trail fees. <br /> <br />No Certificate of Occupancy for the structure will be issued until the Required Improvements, <br />or a financial surety for same, are accepted by the City. <br /> <br />IMPROVEMENT CONSTRUCTION SCHEDULE. The Required Improvements shall be <br />completed before September 1, 2006. <br /> / <br /> <br />RECOGNITION OF LOCATION. The Permittee herein agrees to recognize Ramsey as the <br />City of location on all forms of advertising and business correspondence whenever reasonably <br />prudent to do so. <br /> <br />FINANCIAL SURETY. In order to ensure the installation of the Required Improvements in <br />accordance with City specifications and in a timely manner, the Permittee shall be required to <br />deposit with the City a cash escrow or letter of credit, approved as to form by the City, in the <br />amount of One Hundred Twenty-Five Thousand Eight Hundred Fifty-Three Dollars and no <br />cents ($125,853.00), which is 150% of the City's estimated cost of the Improvements. Prior to <br />the issuance of the building permit, all financial guarantees must be provided as required <br />herein. <br /> <br />Upon completion of the construction of the Required Improvements, the financial guarantee <br />shall be returned to the Permittee and the Permittee shall be required to provide the landscaping <br />maintenance guarantee described in Item #12 of this Development Permit. The determination <br />of' completion of the construction of the Required Improvements shall be made by the City <br />Council after consultation with the City Engineer. In the event the Permittee fails to construct <br />anti install the Require. d Improvements as required herein, the City Council may order the <br />completion of the Required Improvements with City day labor and/or by letting contracts for <br />said completion and draw upon the escrow for payment. Only the City Council shall have the <br />authority to direct completion of the Required Improvements and withdraw from the escrow <br />account.
