Commissioner Brauer seconded the <br />amendment to thc motion. <br /> <br />Commissioner Brauer stated that in terms of violations, his reason for granting this interim use <br />permit is that it is a low manufacturing use, with limited trips per day, and no arguments from <br />neighbors. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Levine, <br />Shepherd, and Van Scoy. Voting No: None. Absent: Commissioner Watson. <br /> <br />Case #3 <br /> <br />Request for a Ninety Day Extension to a Mining and Grading Conditional <br />Use Permit; Case of Erie Thomsen <br /> <br />Presentation <br /> <br />Assistant Community Development Director Frolik advised that the City has received an <br />application from Eric Thomsen to renew a Conditional Use Permit to grade and export soils from <br />an area generally located west of T.H. #47 and south of County Road #62, at about Vanadium <br />Street NW. She indicated the City Council issued a Conditional Use Permit for grading and <br />mining activities to Eric Thomsen in 2000. She noted that permit expired in 2002, and the City <br />Council renewed the Conditional Use Permit in 2002 with a permit that expired June 25, 2005. <br /> <br />Assistant Community Development Director Frolik stated Mr. Thomsen and his contractor, Eagle <br />Trucking, estimate that it will take approximately 90 days to complete the grading and mining <br />plan approved in 2000. She stated therefore, Mr. Thomsen is applying for a 90 day renewal of <br />thc grading and mining Conditional Use Permit. <br /> <br />Assistant Community Development Director Frolik indicated the City Engineering Department <br />inspected the site on July 1, 2005. She stated the perimeter of the excavation needs to be <br />reshaped to a 4:1 slope. She indicated approximately one-third of the excavated areas has been <br />established with turf. She stated the grading operations are in general compliance with the <br />overall excavation plan, but is not in total compliance with the phasing plan. <br /> <br />Assistant Community Development Director Frolik stated City Staff recommends approval of the <br />permit contingent upon a restriction of any further exporting of material until the following are <br />accomplished: <br /> · Excavation area has been reshaped to a 4:1 slope. <br /> · All but a maximum five-acre excavation area is established with turf. <br /> <br />Assistant Community Development Director Frolik stated the proposed 'variable' findings are <br />thc same that were arrived at in 2002 and support approval of the request to renew the permit. <br /> <br />Chairperson Nixt asked if the permit would be issued once the site was within the guidelines, or <br />it' the City has a performance bond. <br /> <br />Planning Commission/July 7, 2005 <br /> Page 6 of 16 <br /> <br /> <br />
