Assistant Community Development Director Frolik stated it would be issued once the site was <br />within thc guidelines. <br /> <br />Mr. Tbomscn indicated the 4:1 slope is on the west side. He stated there was some gravel in the <br />slope that was being mined out, and sandy soil will be put back. He indicated there is about 3 ½ <br />acres restored, but it should have been 4 ½ acres. He stated the process has been to leave a berm <br />as an erosion control measure from the wetland until the rest is done. He indicated the <br />excavation started on one end and is being worked forward. He stated the berm is in place, and <br />he has top soil fi'om when the project started. He noted his contractor has some import top soil <br />fi'om another project that will increase the depth of the top soil, so it is not all restored as the <br />phasing plan showed. <br /> <br />Assistant Community Develop~nent Director Frolik indicated approval could be subject to <br />working with Staff to get the site in compliance. <br /> <br />Public Input <br /> <br />Chairperson Nixt opened the public hearing at 7:45 p.m. <br /> <br />Mike Villeneuve, 6230 177t~' Lane stated he has no problem with the mining of the land; he just <br />wants to make sure the roads are continually cleaned with a sweeper. He indicated last time this <br />was being worked on they got a little lax with the cleaning, and the winds blew the dirt into the <br />residential area. He stated it needs to be wet down and swept frequently. <br /> <br />Comm issioncr Brauer noted it is a condition of the permit. <br /> <br />Mr. Villcncuve stated as long as it happens he is fine with it, but that condition has been in there <br />all along and has not always been enforced. He indicated he hopes it does not take too much <br />longer. <br /> <br />Commissioner Levine noted there is also a provision that there can be no hauling in winds of 30 <br />mph or greater. <br /> <br />Motion by Chairperson Nixt, seconded by Commissioner Johnson to close the public hearing at <br />7:47 p.m. <br /> <br />Motion carried. Voting Yes: Chairperson Nixt, Commissioners Johnson, Brauer, Levine, <br />Shepherd, and Van Scoy. Voting No: None.
