CASE #

ADOPT AMENDMENT TO ORDINANCE FOR SEWER AND WATER TRUNK
CHARGE HOOK-UP RATE ]FOR ~RA~/SEY TOWN CENTER 2~D ADDITION
By: James E. NO~r.m'an~ City Administrator
Background:

The ¢,mnsey Town Center (RTC) entered i~to .an .option agreement approximately two years ago
with D.R. I-torten, a major housing developer, to construct approximately 60 acres of the
residential development, amounting to approximately 900 dwelling units, in the Town Center
(map attached). Recently, negotiations h. hve 'been underway to create an amendment to the
option agreement that would reduce the role of D.R. Horton to a 12-acre parcel in the Town
Center, also known as Ramsey'Tow~ Cehter:2"a Addition. Limiting the role of D.R. Horton
would allow for more housing develoPment variety and allow more building projects to happen
concm'rcntly rather than on a consecutive!Basis as proposed by D.R. Horton. Staff has been
supportive of the negotiations between the RTC and D.R. Horton.

The allocation agreement for the RTC.2na Addition allows the developer to pay for the sewer and
water trtmk hook-up charges at the time of the building permits rather than the usual method of
paying th~'m at the time of final plat. That being the case, the building permit fees have not been
initiated and the sewer and watei' trunk h0~ok-up charges have not been paid. In order for the
option agreement between RTC and D.R. iHorton to be completed, D.R. Herren has requested
that the 103 residential units in RTC 2na Addition be able to use 2004 sewer and water trunk
hoolc-up Fees.

Staf'f believes that allox~ing 2004 sewer and water trunk hook-up fees is a small price to pay for a
better- residential development in the TownlCenter and recommended Council authorize the rates
to complete the option agreement at.the Council meeting of January 11, 2005. Staff fm'ther
recommended that future allocation agreem, eixts do not allow for sewer and water trunk hook-up
fccs to be deferred at time of final plat. Sigee:sewer and water hook-up fees are adopted during
thc ammal rates, fees and charges ordinance, the'City Attorney advised that the action required
amendment to the annual rates, fees andcharges ordinance. The ordinance was introduced at the
January I 1th meeting and is now ready for Gouncil adoption consideration.

Council Action:

Motitm to adopt Ordinance #052XX to collect .sewer and water trunk hoOk-up charges at the
2004 rate scheduled for the Ramsey Town Center 2na addition and direct staff that ali fitture
sewer and water trunk hook-up charges are collected at time of final plat.

Reviewed by:
City Administrator
City Attorney
Finance Officer

CC: 111/25/05
