<br />Please Note: this resolution was tabled at the 12/14/21 City Council meeting – resulting in <br />no resolution #21-358. <br /> <br />Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION #21-358 <br /> <br />RESOLUTION TO PROHIBIT STATE AND FEDERAL ACTORS FROM MANDATING <br />MEDICAL PRECEDURES UPON CITIZENS THROUGH COERCION OR FORCE; AND <br />PROVIDING OTHER MATTERS RELATED TO THE SUBJECT <br /> <br /> WHEREAS, according to the Centers for Disease Control (CDC) “immunization with a <br />safe and effective COVID-19 vaccine is a component of the United States strategy to reduce <br />COVID-19 related illnesses, hospitalizations, and deaths and to help restore societal functioning” <br />; and <br /> <br /> WHEREAS, the stated goal was to have enough COVID-19 vaccines/shots for all people <br />in the United States who wish to be inoculated; and <br /> <br /> WHEREAS, the Bill of Rights was necessary to prohibit state and federal actors, public <br />and private, from infringing upon individual liberties; 1st Amendment religious freedoms; and 4th <br />Amendment protections of privacy and bodily integrity; and the 14th Amendment to the US <br />Constitution explicitly directs states not to “deprive any person of life, liberty, or property, without <br />due process of law; nor deny to any person within its jurisdiction the equal protection of the laws” <br />; and <br /> <br /> WHEREAS, the outcome of Cruzan v. Director, Missouri Department of Health, 497 <br />U.S. 261 (1990) states (b) a competent person has a liberty interest under the Due Process Clause <br />in refusing unwanted medical treatment; and <br /> <br /> WHEREAS, with the exception of the Pfizer vaccine for adults, emergency use products <br />are specifically prohibited by federal law 21 U. S. C. Section 360bbb-3e(1)(A)(ii)(III) from being <br />mandated: “Authorization for medical products for use in emergencies … require …the option to <br />accept or refuse administration of the product”; and <br /> <br />WHEREAS, administration of the COVID-19 Vaccine/shots according to guidelines <br />established by the CDC’s Advisory Committee on Immunization Practices do no provide adequate <br />legal protections for average Americans concerned about potential health hazards associated with <br />the inoculations instead provide immunity to the pharmacy companies; and <br /> <br />WHEREAS, the doctors, nurses administering the inoculation are required by law to give <br />informed consent and they cannot do so if they themselves are not informed of long-term studies <br />over several years; and <br /> <br /> <br />
