WHEREAS, the Property Owner has not paid for the administrative citation; and <br /> <br /> WHEREAS, the Property Owner has not contacted Staff to complete the Home <br />Occupation Permit application; and <br /> <br /> WHEREAS, a third notice of violation was sent on July 2, 2021 to Property Owner with <br />second citation. <br /> <br /> WHEREAS, a first notice of abatement was sent on July 16, 2021 to notify Property <br />Owner of code enforcement case being brought to City Council for an abatement on August <br /> <br />FINDINGS OF FACT <br /> <br />1. The City inspected the property most recently from the road on: <br /> <br />a. April 28, 2021; <br />b. May 13, 2021; and <br />c. July 2, 2021; <br /> <br />2. Property Owner has not completed Home Occupation Permit application or removed <br />violations from the Subject Property. <br /> <br />3. The City sent formal notices via US Mail on: <br /> <br />a. April 29, 2021 for a first notice of violation requesting the proper storage or removal <br />of items being stored outside and information on what appeared to be a home <br />occupation. The notice cited City Code requesting off-street parking violation items <br />to be removed or properly stored, the Property Owner to apply for a Home <br />Occupation Permit, and for public nuisances to be properly stored or removed.. <br />b. May 14, 2021 for a second notice of violation requesting the proper storage or <br />removal of items being stored outside; or the Property Owner to apply for a Home <br />Occupation Permit. The notice cited City Code requesting off-street parking violation <br />items to be removed or properly stored, home occupation violation, and included a <br />first citation of $75.00. <br />c. July 2, 2021 for a third notice of violation requesting the Property Owner complete <br />the Home Occupation Permit or cease operating the business from the Subject <br />Property. Citation for $250.00 was included in the letter. <br /> <br />4. The City has not received payment from the Property Owner for the administrative <br />citations, or correspondence since the submitted incomplete application via email on June <br />28, 2021. <br /> <br />5. The City has sent a first notice of abatement with date of City Council meeting, July 27, <br />2021, should the Property Owner like to attend.
