Councilmember Strommen stated she still has concerns regarding the odors. She has received <br />complaints from people that work at businesses in the area, and they likely do not take the time <br />to call the City and complain. Part of her concern is that there will be more housing going in <br />along I tighway 10 and the City has been working hard to recruit other businesses to the business <br />parks there. There have been a lot of investments to upgrade some of these areas, and she has a <br />concern about the potential for creating odors with the people and businesses in the area. She <br />suggested a plan be determined for how to deal with odor problems, or the option of granting a <br />conditional use permit for less than five years with a more frequent review option. <br /> <br />Mike Caron, representative of Tiller Corporation, stated he met with the Council about 1 ½ years <br />ago shortly after there was a concern from some of the nearby businesses about the odor. They <br />have made changes in the way they operate the plant; it is operated for longer periods of time, <br />rather than starting and stopping. This reduces the odors that are emitted from the bag house. <br />Since this change has been made there have not been any complaints received. He encourages <br />staff and the Council to inform Commercial Asphalt if any complaints are received, as they keep <br />records of what is produced, when it is produced, and the temperature and direction of the wind. <br />Through that process they can work to make the plant acceptable in the area. <br /> <br />Councilmember Strommen explained she has received complaints recently. She inquired what <br />options might be available to control the odors. <br /> <br />Mr. Caron replied without knowing the day, the temperature and the mix he does not have <br />enough information. He stated as a company, Commercial Asphalt wants to work with the cities <br />they operate in. They operate in ten different cities and they try to maintain a good positive <br />relationship between themselves, staff and the Council. If there is a problem they want to know <br />so they can work with the City. <br /> <br />Councihnember Elvig stated he respects that this company has been so accommodating with the <br />City. Ite noted there had been a discussion about the possibility of a higher stack. <br />Councilmember Strommen has made a good point that more people are moving into this area, <br />an.d they may want to review this permit in three years. <br /> <br />Ms. Frolik explained with the last permit it was discussed whether there should be an interim <br />permit granted, which would have a maximum of five years. Commercial Asphalt preferred the <br />conditional use permit and agreed to the five-year timeframe. <br /> <br />Mayor Gamec stated this firm has always worked with the City. If there are complaints from <br />people they will need to come forward with those complaints. <br /> <br />Motion by Councilmember Cook, seconded by Councilmember Olson, to adopt Resolution #05- <br />08-281 adopting Findings of Fact #0739 relating to Commercial Asphalt's request for a <br />conditional use permit for a hot mix asphalt plant; and to adopt Resolution #05-08-282 approving <br />the request for a conditional use permit from Commercial Asphalt, based on the findings of fact, <br />and declaring terms of same. <br /> <br />City Council / August 23, 2005 <br /> Page 8 of 28 <br /> <br /> <br />
