Homeowners' association (HOA) means an organization comprising neighbors concerned with managing the
<br />common areas of a subdivision, governed by a board, that create a set of bylaws, in addition to city regulation, to
<br />govern themselves. These boards own and maintain commonly -held land within a townhouse or single-family
<br />development, and are responsible for private street maintenance, snow removal, landscaping, and/or building
<br />maintenance. Each homeowners' association varies in its scope and responsibilities. The homeowners' association
<br />is responsible for enforcing any covenants, conditions, and restrictions that apply to the property.
<br />Horse boarding, commercial, means the housing or keeping of horses for profit. Horse boarding will be
<br />considered to be commercial when horse care is offered to the general public through any form of advertising.
<br />Horse boarding, noncommercial, means the housing or keeping of horses for friends, neighbors, and relatives
<br />when the charge for such boarding is limited to the actual costs incurred and the person providing the service has
<br />not attempted to solicit business through any form of advertising.
<br />Hydric soils means soils that are saturated, flooded, or ponded long enough during the growing season to
<br />develop anaerobic conditions in the upper part.
<br />Hydrophytic vegetation means macrophytic (large enough to be observed by the naked eye) plant life
<br />growing in water, soil or on a substrate that is at least periodically deficient in oxygen as a result of excessive water
<br />content.
<br />Illicit discharge means any direct or indirect non-stormwater discharge to the storm sewer system except as
<br />exempted in section 117-414(b)(2).
<br />Illuminated sign means any sign which is illuminated by an artificial light source.
<br />Impervious surface means:
<br />(1) A constructed hard surface that either prevents or retards the entry of water into the soil, and causes
<br />water to run off the surface in greater quantities and at an increased rate of flow than existed prior to
<br />development. Examples include rooftops, sidewalks, patios, driveways, parking lots, storage areas, and
<br />concrete, asphalt, or gravel roads; or
<br />(2) A properly maintained artificial surface through which water cannot easily penetrate or a constructed
<br />hard surface that either prevents or retards the entry of water into the soil, and causes water to run off
<br />the surface in greater quantities and at an increased rate of flow than existed prior to development.
<br />Examples include rooftops, sidewalks, patios, driveways, parking lots, storage areas, and concrete,
<br />asphalt, or gravel roads.
<br />Improvements means the construction or installation of public or private utilities, including but not limited
<br />to, potable water, sanitary sewer systems, storm sewers, roads and other thoroughfares, sidewalks, curbs and
<br />gutters, paving barricades, trees and other plantings, lighting, fuel or energy and the transmission thereof,
<br />transportation systems or facilities connected therewith and communication systems which are necessary,
<br />desirable or convenient in the maintenance of the health, safety and the general welfare.
<br />Incinerator means any furnace or other device used in the process of burning solid waste, hazardous waste,
<br />medical waste or special waste for the purpose of reducing the volume of the waste by removing combustible
<br />material.
<br />Industrial solid waste.
<br />(1) The term "industrial solid waste" means all solid waste generated from an industrial or manufacturing
<br />process and solid waste generated from non -manufacturing process and solid waste generated from
<br />non -manufacturing activities such as service and commercial establishments.
<br />(2) The term "industrial solid waste" does not include office materials, restaurant and food preparation
<br />waste, discarded machinery, demolition debris, or household refuse.
