meet the minimum lot area, length of water frontage, structure setbacks or other dimensional standards of this <br />chapter. <br />Substantial damage means damage of any origin sustained by a structure where the cost of restoring the <br />structure to its before damaged condition would equal or exceed 50 percent of the market value of the structure <br />before the damage occurred. <br />Substantial improvement means within any consecutive 365-day period, any reconstruction, rehabilitation <br />(including normal maintenance and repair), repair after damage, addition, or other improvement of a structure, <br />the cost of which equals or exceeds 50 percent of the market value of the structure before the "start of <br />construction", as defined in 44 Code of Federal Regulations 59.1, of the improvement. This term includes <br />structures that have incurred Substantial Damage, regardless of the actual repair work performed. The term does <br />not, however, include either: <br />(1) Any project for improvement of a structure to correct existing violations of state or local health, <br />sanitary, or safety code specifications which have been identified by the local code enforcement official <br />and which are the minimum necessary to assure safe living conditions. <br />(2) Any alteration of a "historic structure", as defined in 44 Code of Federal Regulations 59.1, provided that <br />the alteration will not preclude the structure's continued designation as a "historic structure." <br />Surface water -oriented commercial use means the use of land for commercial purposes, where access to and <br />use of a surface water feature is an integral part of the normal conductance of business. Marinas, resorts, and <br />restaurants with transient docking facilities are examples of such use. <br />SWPPP means storm water pollution prevention plan. <br />Temporary protection means short-term methods employed to prevent erosion. Examples of such protection <br />include; mulch, erosion control blankets, wood chips, and erosion netting. <br />Temporary real estate office means a structure with or without a foundation or footings, used only as a <br />temporary real estate office, which is open to the general public. <br />Temporary sign means a sign which is erected or displayed for a limited period of time and not affixed to a <br />Minnesota State Building Code approved structure. <br />Toe of the bluff means the lower point of a 50-foot segment with an average slope exceeding 18 percent. <br />Top of the bluff means the higher point of a 50-foot segment with an average slope exceeding 18 percent. <br />Topping means cutting back a tree to buds, stubs, or laterals not large enough to assume the terminal role. <br />Topsoil means black dirt composed of unconsolidated material, largely undecomposed organic matter that is <br />a suitable foundation for vegetative growth. The composition of topsoil should contain no more than 35 percent <br />sand content. <br />Tower means any ground or roof -mounted pole, spire, structure, or combination thereof, including <br />supporting lines, cables, wires, braces, and masts, intended primarily for the purpose of mounting an antenna, <br />meteorological device, or similar apparatus above grade. <br />Tree means any woody plant that has at least one trunk whose diameter four feet above ground is four <br />inches or greater. <br />Tree diameter, wherever this term is used in reference to the measurement of a tree, means a tree's trunk as <br />measured 4.5 feet (54 inches) above the ground. <br />Tree owner means the owner of the real property upon which 51 percent or more of the trunk is located at <br />ground level. <br />(Supp. No. 10, Update 3) <br />Created: 2021-10-01 10:38:19 [EST] <br />Page 30 of 34 <br />
