Councihncmbcr Pearson introduced the following resolution and moved for its adoption: RESOLUTION #05-07-234 A RESOlJUTION ADOPTING FINDING OF FACT #0731 RELATING TO A REQUEST FROM ERIC THOMSEN FOR A CONDITIONAL USE PERMIT TO GRADE AND EXPORTS SOILS WHEREAS, the City of Ramsey received an application from Eric Thomsen for a re- issuance ora conditional use permit to grade and export excess soils from the property legally described as fbllows: That part of the Southwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying northerly of the centerline of Trott Brooks, subject to easement of record; -~llld- 'l'hc Northwest Quarter of the Southwest Quarter of Section 2, Township 32, Range 25, Anoka County, Minnesota, lying southerly of County Road #63 (the "Subject Property"). NOW TtlEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA that the findings of fact relating to the request arc determined to be as follows: That thc City Council approved a conditional use permit for this property on March 25, 1997, but iht conditional use permit was not initiated and completed within three years of the final action of the City Council and it is considered null and void. 2. That the City Council approved a conditional use permit on May 23, 2000 for the contimmtion of this same activity, which expired in June 2002. 3. Thai thc City Council renewed the Conditional Use Permit on June 25, 2002, with an expiration date of June 25, 2005. -. ~l'hat on June 23, 2005, Eric Thomsen, hereinafter referred to as "Applicant", properly applied tbr thc re-issuance of a conditional use permit to grade and export excess soils from the Subject Property. That the applicant appeared before the Ramsey Planning Commission for a public hearing pursuant to Section 9.03.05of the City Code on July 7, 2005 and that said public hearing was properly advertised and that the minutes of said public hearing are hereby incorporated as a part ol'thcsc findings by reference.
