C()t,ncilmcm ber Cook introduced the following resolution and moved for its adoption: RESOLUTION #05-08-281 A RESOI,UTION ADOPTING FINDINGS OF FACT #0739 RELATING TO COMMERCIAL ASPHALT'S REQUEST FOR A CONDITIONAL USE PERMIT TO CONTINUE TO OPERATE AN ASPHALT PRODUCTION PLANT IN THE E-2 EMPLOYMENT DISTRICT WIIEREAS, Commercial Asphalt, hereinafter referred to as Applicant, has properly applicd for a conditional use permit to continue to operate an asphalt production plant in the E-2 l~mploymcnt District on the property generally known as 14100 Basalt Street N.W. and legally dcsct'ibcd as/bllows: That part of the Northwest Quarter of the Northeast Quarter, and of the Northeast Quarter o1' the Northwest Quarter, both in Section 34, and of the Southwest Quarter of the Southeast Quarter of Section 27, all in Township 32, Range 25, Anoka County, Minnesota described as follows: Commencing at the northeast comer of said Section 34; thence on an assumed bearing of South 0 degrees 55 minutes 06 seconds East, along the east line of said northeast Quarter, a distance of 1321.75 feet to the northeast comer of Government Lot 4 of said Section 34; thence South 89 degrees 36 minutes 21 seconds West a distance of 1623.71 feet to the intersection with a line marked by judicial landmarks set pursuant to Torrens Case No. T- 2694; thence North 0 degrees 42 minutes 25 seconds West, along said line, a distance of 243.04 feet in the intersection with the southerly railroad right-of-way line of Burlington Northern Railroad Company, said point being marked by a judicial landmark set pursuant t{-~ Torrens Case No. T-2694; thence continue North 0 degrees 42 minutes 25 seconds West a distance of 136.84 feet to its intersection with the northerly railroad right-of-way linc oF Burlington Northern Railroad Company and the point of beginning of the land to be described; thence continue North 0 degrees 42 minutes 25 seconds West a distance of 942.45 feet to the southwest comer of Lot 2, Block 4, GATEWAY NORTH INDUSTRIAL PARK PLAT 2; thence North 0 degrees 18 minutes 20 seconds West, along the west line of said Lot 2, a distance of 30.00 feet; thence South 86 degrees 11 minutes 17 seconds West a distance of 500.00 feet to a point on the north line or said Northwest Quarter of the Northeast Quarter distant 496.28 feet east, as measured said along said north line, from the northwest comer of said Northwest Quarter of the Northeast Quarter; thence South 17 degrees 41 minutes 36 seconds West a distance of 210.37 feet to the intersection with the south line of the north 200.00 feet of said Northwest Quarter of the Northeast Quarter, as measured along the west line thereof at a point thereon distant 430 feet east from the west line of said Northwest Quarter of the Northeast Quarter; thence South 89 degrees 37 minutes 40 seconds West, along said south line of the north 200.00 feet, a distance of 430.00 feet to the west line of said Northwest Quarter of the Northeast Quarter; thence South 35 degrees 45 minutes 23 seconds West a distance of 285.11 feet to the intersection with said northerly railroad right-of-way; thence South 66 degrees 41 minutes 37 seconds East, along said railroad right-of-way line, a distance of 1275.26 feet to the point of beginning.
